MASHPEE BOARD OF APPEALS <br />0 Minutes <br />March 14, 1990 <br />The Mashpee Board of Appeals held a meeting at 7:30 p.m. on Wednesday, <br />March 14, 1990 at the Mashpee Town Hall. Board members present and acting <br />throughout were Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br />Associate member Richard E. Halpern was present for the first four <br />hearings and left the room from 8:30 p.m. to 9:30 p.m. Building <br />Inspector Douglas S. Boyd was in attendance. <br />Francis J. LaBrecque - (Owner of record: Francis J. and Lori S. <br />LaBrecque) - Request a Special Permit under Sections 174-17 and 174-33 <br />of the Zoning By-laws for permission to reconstruct and expand a non- <br />conforming structure in an R-3 zoning district on property located at <br />8 Capstan Circle (Map 111, Block 99) Mashpee, MA. <br />Members present: C. Hawver, M. Makunas, J. Friel, R. Halpern <br />Attorney Kevin Kirrane represented the applicant. He explained <br />that the property is within 50' from wetlands and owner wishes to <br />reconstruct the 20 -year old structure and add a second floor, screened - <br />in porch and wood deck. He explained that what is proposed exceeds <br />• the 20% lot coverage but owner is willing to reduce size of deck to <br />conform to the 20% lot coverage. He informed the Board that the <br />Conservation Commission had given an order of conditions and the <br />Board of Health has approved the plans. There were no comments from <br />abutters. <br />Mr. Makunas moved to grant the Special Permit and specify that <br />lot coverage be limited to 20%. Mr. Friel seconded. All agreed. <br />Marjory Gordon - Requests a Variance from Section 174-31 of the <br />Zoning By-laws for permission to vary the setback requirements in an <br />R-3 zoning district on property located at 31 Nick Trail (Map 117, <br />Block 271) Mashpee, MA. <br />Members present: C. Hawver, M. Makunas, R. Halpern, J. Friel <br />Builder John Gavin represented the applicant. He explained that <br />Ms. Gordon now has a non -conforming metal shed which is used for the <br />storage of trash barrels. She wishes to replace it with a wooden <br />storage bin. Mr. Makunas reviewed the plans and asked that a copy <br />signed by the engineer be submitted to the Board. <br />A. Barbara Porter, an abutter, spoke in favor of the permit. <br />Mr. <br />Friel moved to take the Petition under advisement. Mr. <br />Makunas <br />seconded. <br />All agreed. Ms. Gordon offered to return to her home <br />and get <br />pictures <br />of the shed and Mr. Makunas said the Board would review <br />them. <br />
