BOARD OF APPEALS Minutes - March 14, 1990 2. <br />• P. 6 H. Trust - (Owner of record: Paul J. Hartel and William W. <br />Peters TR) Request a Special Permit under Section 174-25 of the Zoning <br />By-laws for permission to construct Building E of Deer Crossing in a <br />C-1 zoning district on property located at 681 Falmouth Road (Map 81, <br />Block 35) Mashpee, MA. <br />Members present: C. Hawver, M. Makunas, R. Halpern, J. Friel <br />Attorney Michael Dunning represented P. 6 H.'Trust. He explained <br />that Buildings A, B, C and D at Deer Crossing were constructed between <br />1983 and 1986 without a Special Permit. The Building Inspector at <br />that time considered that a Special Permit was not necessary for the <br />buildings but only for the occupants. The interpretation of the <br />Zoning By-law has now changed and Town Counsel and Mr. Boyd had <br />agreed that a Special Permit is now required. <br />Building E will be 13,058 sf affixed to Building D. Mr. Dunning <br />said that Design Review had approved the plans. There are 293 parking <br />spaces for the entire complex which exceeds the 206 spaces required <br />by the By-laws. He said Design Review had imposed the condition that <br />the applicant install a final asphalt course on the entire parking area <br />when construction is completed. <br />Peter Hartel reviewed the plans with the Board. He explained <br />that the space will be used for office and retail and that the <br />• roadway will provide an entry to Deer Crossing Condominiums. <br />Mr. Friel asked if there were plans to connect with Mashpee Commons <br />and Mr. Hartel responded that they would like to do this. Mr. Boyd <br />stated that the Master Plan of the area would have connections <br />between the two shopping centers. <br />There was discussion if the permit was for Building E only or <br />the entire complex and Mr. Boyd reported that Town Counsel had suggested <br />a Special Permit for Building E only since the other buildings had <br />valid building permits. <br />Judy Mills, a concerned citizen of Mashpee, asked how water would <br />be supplied and Mr. Hartel responded that he had talked with the water <br />district. <br />Elias McQuaid, Health Agent, asked if the Special Permit was <br />granted would it be subject to the Cape Cod Commission Act, if passed. <br />Mr. Friel answered that it was not in the jurisdiction of the Board of <br />Appeals to refer projects but that the Building Inspector would have <br />the referral power. <br />Judy Mills suggested that the plans include a statement that they <br />will be tying into the municipal water system and Mr. Hartel replied <br />that this would be included. <br />Mr. Friel moved to take the petition under advisement. Mr. Makunas <br />seconded. He expressed concern that there may be other areas of the project <br />which could be corrected. He said he would like input from the Planning <br />Department and suggested the Board solicit comments from other Town Depart- <br />ments. All agreed. <br />
