BOARD OF APPEALS Minutes - March 14, 1990 3. <br />Vincent S. Porciello Jr. - (Owner of record: Christopher Burden TR) <br />Requests a Variance under. Sections 174-31,.174-33, 174-86 of the Zoning <br />By-laws for permission to vary the set -back requirements and to build in <br />the A.C.E.C. in an R-3 zoning district on property located at 35 Wheelhouse <br />Lane (Map 120, Block 164) Mashpee, MA. <br />Members present: C. Hawver, M. Makunas, J. Friel, R. Halpern. <br />Engineer John Slavinsky represented the Applicant. He informed the <br />Board that the plans had been denied by the Board of Health and he was <br />in the process of completing revised plans. He was advised to withdraw <br />and submit a new application when plans were complete. <br />Mr. Makunas moved to accept the request for withdrawl without prejudice. <br />Mr. Friel seconded. All agreed. <br />Mr. Halpern stepped down from the Board and left the room. <br />Kempton Kab Inc. - (Owner of record: Riverbend Realty Trust) - <br />Requests a Special Permit under Section 174-17 of the Zoning By-laws for <br />permission to change a non -conforming use in an R-5 zoning district on <br />property located at 100 Great Neck Road North (Map 45, Block 3) Mashpee, MA. <br />Members present: C..Hawver, M. Makunas, J. Friel <br />Theresa Kempton informed the Board that she was planning a taxi office <br />at 100 Great Neck Road North in a former real estate office. She had asked <br />Deer Crossing and Mashpee Commons for taxi stands and would have one cab <br />parked at Great Neck Road North at night. The business would have three cabs. <br />Mr. Friel asked ii she had a license and Ms. Kempton replied that she <br />cannot get a license from the Selectmen until there is an office. <br />Judy Mills, a direct abutter, informed the Board that she was opposed <br />to any expansion of use on the property. She explained that she and her <br />husband purchased their land in 1982 when the adjacert property was a <br />seasonal motel with a coffee shop and restaurant. She said the motel was <br />sold in 1986 and there are 31 apartments, 19 motel rooms, a real estate <br />office and laundromat. She said the property has no public water supply <br />and older septic systems, and questioned current parking requirements. <br />She said that the impact on her land has been trespassers, property <br />damage, trash and noise at night. She stated that one of her chickens had <br />been axed to death by a child visiting and a chicken shed burned down. <br />She said that the impact to the Town is the loss of revenue from motel taxes <br />and increasing the number of children in the schools. She said members of <br />the School Committee had indicated many of the children were special needs <br />students. She commented that there was adequate commercial space for rent <br />elsewhere in Mashpee. <br />Ms. Kempton replied that she had investigated other locations but could <br />not afford the $700 - $800 rents being charged. <br />Marie Scalley, a concerned citizen of Mashpee, stated that she considers <br />there is a traffic problem in the summer at this location and cars are parked <br />on both sides of Great Neck Road North. <br />r <br />
