VBoard OF APPEALS Minutes - March 28, 1990 3. <br />Mr. Kirrane suggested to the Board given the criteria that <br />• must be met under the terms and conditions of the by-law relating <br />to the issuance of the Special Permit for a dock. One must be able <br />to demonstrate that there is no substantial adverse impact to the <br />marine or coastal environment. He would suggest to the Board that <br />as a part of consideration of the Conservation Commission that <br />having issued the order of conditions which is in order to protect <br />various interests that are intended to be protected by the Wetlands <br />Protection Act, he would suggest that the criteria for the issuance <br />of the dock permit under the local zoning by-law are met with <br />respect to the demonstaation of no adverse impact. In conjunction <br />with his submittal he also has provided the Board with a copy of <br />the Shellfish survey. According to the Shellfish survey the dock <br />would not pose a threat to the marine environment. <br />C. Hawver read a memo from Paul Sommerville the Shellfish <br />Warden. He does not feel that this structure will cause any problem <br />to the reservation of the marine environment. <br />M. Makunas moved that they grant the request stipulating that <br />the order of conditions from the Conservation Commission are met. <br />W. Hanrahan seconded. All agreed. <br />Tauno Metsisto - (Owner of record: Audrey D. Miller)- Requests <br />.a Special Permit under Section 174-25.I.9 of the Zoning By-laws <br />for permission to remove an existing pier, ramp and float and construct <br />and relocate a new pier ramp and float in an R-3 zoning district <br />on property located at 139 Summersea Road (Map 105, Block 7) <br />Mashpee, Ma. <br />Members present: C. Hawver, J. Friel, R. Halpern, W. Hanrahan, <br />M. Makunas <br />Jeff Ryther represented Mr. Metsisto. He explained they are <br />proposing to move the structure which_is.4' by 641. There is an <br />existing float which they plan to move. They are requesting a <br />10' by 20' float. <br />C. Hawver read a memo from Paul Sommerville stating that he <br />does not feel as though this proposal will cause a disruption to <br />,'the marine coastal environment. <br />No comments were submitted from Conservation Commission. <br />M. Makunas moved to grant the request. W. Hanrahan seconded. <br />All agreed. <br />A <br />
