Mr. Kirrane suggested to the Board given the criteria that • must be met under the terms and conditions of the by-law relating to the issuance of the Special Permit for a dock. One must be able to demonstrate that there is no substantial adverse impact to the marine or coastal environment. He would suggest to the Board that as a part of consideration of the Conservation Commission that having issued the order of conditions which is in order to protect various interests that are intended to be protected by the Wetlands Protection Act, he would suggest that the criteria for the issuance of the dock permit under the local zoning by-law are met with respect to the demonstaation of no adverse impact. In conjunction with his submittal he also has provided the Board with a copy of the Shellfish survey. According to the Shellfish survey the dock would not pose a threat to the marine environment. C. Hawver read a memo from Paul Sommerville the Shellfish Warden. He does not feel that this structure will cause any problem to the reservation of the marine environment. M. Makunas moved that they grant the request stipulating that the order of conditions from the Conservation Commission are met. W. Hanrahan seconded. All agreed. Miller)- Requests .a Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to remove an existing pier, ramp and float and construct and relocate a new pier ramp and float in an R-3 zoning district on property located at 139 Summersea Road (Map 105, Block 7) Mashpee, Ma. Members present: C. Hawver, J. Friel, R. Halpern, W. Hanrahan, M. Makunas Jeff Ryther represented Mr. Metsisto. He explained they are proposing to move the structure which_is.4' by 641. There is an existing float which they plan to move. They are requesting a 10' by 20' float. C. Hawver read a memo from Paul Sommerville stating that he does not feel as though this proposal will cause a disruption to ,'the marine coastal environment. No comments were submitted from Conservation Commission. M. Makunas moved to grant the request. W. Hanrahan seconded. All agreed. A
