MASHPEE BOARD OF APPEALS <br />• Minutes <br />Wednesday, April 25, 1990 <br />The Mashpee Board of Appeals held a meeting at 7:30 p.m. on <br />Wednesday, April 25, 1990 at the Mashpee Town Hall. Board members <br />present and acting throughout were Cheryl A. Hawver, William J. <br />Hanrahan and Edward M. Govoni. Board members Michael A. Makunas <br />and Richard E. Halpern were absent from.,the public hearings and <br />attended the Public Hearing of the Planning Board scheduled at <br />the same time. They returned to the Board of Appeals hearing at <br />9:20 p.m. <br />Anthony Pelusi - Requests a Special Permit under Section 174-25.H.6 <br />of the Zoning By-laws for permission to build and maintain a pier on <br />Mashpee Pond and construct a new deck and stairway on property located <br />in an R-5 zoning district at 4 Melissa Avenue (Map 21, Block 3) <br />Mashpee, MA. <br />Members present: C. Hawver, W. Hanrahan, E. Govoni <br />Larry Hall of Benchmark Surveying and Engineering represented <br />the applicant. He explained that the application had been submitted <br />• under Section 174.25.I.9 and Town Counsel had reviewed the application <br />and found that it should be heard under Section 174-25.H.6. He <br />explained that a new deck would be built over an existing concrete <br />foundation with no changes in the setbacks. He advised the Board <br />that the D.E.P. did not want the removal of the concrete since it <br />would cause more damage to the area. <br />Ms. Hawver read a comment from the Conservation Commission which <br />stated that they would address the wildlife issues of the application <br />in Conservation hearings. Mr. Hall said that the environmental reports <br />had been twice revised to meet the new guidelines of the D.E.P. <br />Mr. Hanrahan moved to grant the permit noting that no negative <br />comments were received by the Board. Mr. Govoni seconded. All agreed. <br />Fred and Suzanne M. Luconi - Request a Special Permit under <br />Section 174-25.I.9 of the Zoning By-laws for permission to rebuild <br />an existing unlicensed pier, ramp and float in an R-3 zoning district <br />on property located at 30 Sand Dollar Lane (Map 105, Block 84) Mashpee, MA. <br />Members present: C. Hawver, W. Hanrahan, E. Govoni <br />Jeff Ryther of Holmes 6 McGrath Engineers represented the applicant. <br />He reviewed his appearance before the Board on February 28, 1990 at <br />which time the Board had granted a permit for a 15' extension of the <br />original pier. Conservation had stated they could not approve the <br />• original structure since it was too close to the saltmarsh. He presented <br />revised plans raising the pier to 5' over the marsh and stated that the <br />entire structure now meets current regulations. <br />
