Board members
present and acting throughout were Cheryl A. Hawver, William J.
Hanrahan and Edward M. Govoni. Board members Michael A. Makunas
and Richard E. Halpern were absent from.,the public hearings and
attended the Public Hearing of the Planning Board scheduled at
the same time. They returned to the Board of Appeals hearing at
9:20 p.m.
Anthony Pelusi - Requests a Special Permit under Section 174-25.H.6
of the Zoning By-laws for permission to build and maintain a pier on
Mashpee Pond and construct a new deck and stairway on property located
in an R-5 zoning district at 4 Melissa Avenue (Map 21, Block 3)
Mashpee, MA.
Members present: C. Hawver, W. Hanrahan, E. Govoni
Larry Hall of Benchmark Surveying and Engineering represented
the applicant. He explained that the application had been submitted
• under Section 174.25.I.9 and Town Counsel had reviewed the application
and found that it should be heard under Section 174-25.H.6. He
explained that a new deck would be built over an existing concrete
foundation with no changes in the setbacks. He advised the Board
that the D.E.P. did not want the removal of the concrete since it
would cause more damage to the area.
Ms. Hawver read a comment from the Conservation Commission which
stated that they would address the wildlife issues of the application
in Conservation hearings. Mr. Hall said that the environmental reports
had been twice revised to meet the new guidelines of the D.E.P.
Mr. Hanrahan moved to grant the permit noting that no negative
comments were received by the Board. Mr. Govoni seconded. All agreed.
Fred and Suzanne M. Luconi - Request a Special Permit under
Section 174-25.I.9 of the Zoning By-laws for permission to rebuild
an existing unlicensed pier, ramp and float in an R-3 zoning district
on property located at 30 Sand Dollar Lane (Map 105, Block 84) Mashpee, MA.
Members present: C. Hawver, W. Hanrahan, E. Govoni
Jeff Ryther of Holmes 6 McGrath Engineers represented the applicant.
He reviewed his appearance before the Board on February 28, 1990 at
which time the Board had granted a permit for a 15' extension of the
original pier. Conservation had stated they could not approve the
• original structure since it was too close to the saltmarsh. He presented
revised plans raising the pier to 5' over the marsh and stated that the
entire structure now meets current regulations.
