.+J <br />BOARD OF APPEALS April 25, 1990 2. <br />Luconi (cont.) <br />• Ms. Hawver read a memo from Conservation in favor of the revised <br />plans. No comments were received from the Shellfish Constable. <br />Mr. Hanrahan moved to grant the Special Permit. Mr. Govoni seconded. <br />All agreed. <br />Rona R. and Marvin B. Schpeiser - Request a Variance under Section <br />174-31 of the Zoning By-laws for permission to vary the setback <br />requirements in an R-3 zoning district on property located at <br />29 Holly Road (Map 112, Block 102) Mashpee, MA. <br />Members present: C. Hawver, W. Hanrahan, E. Govoni <br />Peter Vanderbil represented the applicant. He presented plans <br />for two additions to an existing home. He explained that one of the <br />additions was now to be removed. Mr. Hanrahan informed him that new <br />plans would have to be presented to the Board. He noted that the <br />shape of the lot created a hardship in placing any additions. <br />Ms. Hawver read a comment from an abutter in favor of the application <br />and.a letter from another abutter, John J. O'Neil which related to the <br />tax revaluations. Anthony J. Maggiore, a direct abutter, was present <br />and informed the Board that he had no objections. <br />isMr. Hanrahan moved to take the application under advisement <br />pending receipt of the revised plan. Mr. Govoni seconded. All agreed. <br />Ms. Hawver called a 10 minute recess. At 7:51 p.m. Ms. Hawver <br />reconvened the meeting. <br />Edward R. Wasil - (Dick 6 Ellie's Flea Market) - Request the <br />renewal of Special Permit SP -84-03-01 Condition No. 14. This grant of <br />Special Permit is not transferable by the Applicant except to members <br />of his immediate family, meaning spouse and children. The Applicant <br />may apply annually thereafter for renewal of this Special Permit and <br />receive a new grant thereof following public hearing and review of the <br />operation and its impact upon the neighborhood and the general welfare <br />of the inhabitants of the Town and subject to the addition, deletion or <br />modification of the limitations imposed herein. The hearing will be <br />conducted on said conditions. Dick 6 Ellie's Flea Market is located <br />in a C-1 zoning district -at 650 Falmouth Road, Route 28 (Map 81,Block '4) <br />Mashpee, MA. (Owner of record: Charles R. Talanian TR) <br />Members present: C. Hawver, W. Hanrahan, E. Govoni <br />Attorney Ron Jansson represented the applicant. He informed the <br />Board that Mr. Wasil had received a one-year lease on the land in 1989' <br />and had expected that would be the last year of the flea market. <br />He said that Mr. Talanian, the owner, had decided not to begin building <br />. a major complex on the land and Mr. Wasil arranged for a one-year <br />lease with the right to renew. He said Mrs. Wasil will not be involved <br />in the operation of the flea market in 1990. <br />
