Board of Appeals Minutes - June 27, 1990 3 <br />• of Health requirements. He said the Board of Health would prefer <br />all food operations be under the .management of Fabio's. Mr. <br />Hanrahan stated that the minutes should reflect that the Board of <br />Appeals reviewed the memo from the Board of Health and determined <br />that there is no violation of the Special Permit. <br />Larry Nickulus: Mr. Hanrahan stepped down from the Board and <br />left the room for• this discussion. The Board was informed that <br />Mr. Boyd had asked for the discussion. Town Treasurer, Anne Shaw, <br />had informed the Board that Mr. Nickulus had not paid his real <br />estate ,taxes and, therefore, was not entitled to any building <br />permits. He has paid $50,000 of the $100,000 required for the <br />improvement of Pimlico Pond Road. <br />The Board determined that Ms. Shaw should notify Mr. Boyd and <br />that the Board of Appeals should not be involved. <br />Discussion: Ms. Hawver discussed hearing procedures which <br />she had reviewed with Assistant Town Counsel Leslie Morse. All <br />Board Members present at a hearing may participate in the hearing <br />but motions should not be made by alternate members if the three <br />regular members are present. On matters taken under• advisement an <br />alternate member• who attended all of the hearings may be appointed <br />to vote in place of an absent regular member. <br />• There was discussion that name signs for• the members might be <br />helpful for those appearing before the Board. <br />The Board discussed membership on the Board and reviewed the <br />ad placed in The Enterprise soliciting new members. Mr. Boyd <br />informed the Board that Signature Galleries had paid $50 to the <br />Building Department for a Plan Review and asked that this amount <br />be credited to the Special Permit application fee. The Board <br />agreed. <br />Mr. Hanrahan moved to adjourn at 9:10 p.m. Ms. Hawver <br />seconded. All agreed. <br />Elinor Walsh <br />• <br />
