Board of Appeals July 11, 1990 6 <br />would keep a boat, a dinghy for• example, and not have any more <br />. intensive use than as a dinghy dock to provide access to a <br />mooring. Mr. Makunas said it would be necessary to go out another <br />100 feet to get to a mooring. Mr. Silver, commented that there ar•e <br />at least 12 boats moored in his area. There was discussion of the <br />depth of water, in a cove outside the area. Mr. Dubin said they <br />would like to reach -an accomodation with Conservation and <br />Shellfish. Mr. Makunas said he would be willing to take the <br />petition under advisement if there was a possibility of <br />compromise. <br />Mr. Friel stated that he was at the site with the Shellfish <br />Constable on Sunday and has reservations about the entire project. <br />He said that boats going to the abutters docks had an impact on <br />the area. <br />Mr. Friel moved that the petitions for• a Special Permit and a <br />Variance be denied without prejudice. Ms. Hawver seconded. All <br />agreed. <br />James L. Galvin - (Advisement) <br />The Board requested a 60 -day extension in the hearing <br />calendar since all of the sitting members on the application were <br />not present. Richard Dubin, r•epr•esenting Mr. Galvin, signed the <br />extension. <br />Ms. Hawver• moved to grant the 60 -day extension. Mr. Makunas <br />seconded. All agreed. <br />Minutes - June 27, 1990 - Mr. Makunas moved to accept the <br />minutes. Mr. Friel seconded. All agreed. <br />Discussion <br />1. McDonald's - Mr. Makunas stated that the Design Review <br />Committee had found the design of the building unacceptable. The <br />secretary was instructed to send copies of the application and <br />plans to the Planning Board, Water• District, Rotary by-pass <br />committee, Corridor- of critical concern committee, Board of <br />Health, Police and Fire Departments and request comments before <br />the August 22, 1990 hearing. There was discussion of the <br />applicability of the Cape Cod Commission Act. <br />2. Benison application - The Board determined that two <br />applications were necessary. <br />3. Meetings - The Board voted to cancel the meeting of <br />August 8, 1990. <br />4. Southport - The Board agreed to have a representative of <br />Southport discuss progress at the meeting of July 25. <br />0 <br />5. Mr•. Friel said he would like to send a letter to the <br />
