Mr. Makunas questioned why the Board did not know the State's decision <br />on the entrance. Franklin Ching replied that they hoped to have the <br />decision within the next two weeks. The access and permitting can take <br />a long time and they are asking for a conditional permit now. <br />Mr. Kirrane said he thought the Board could vote on the permit <br />conditionally since the access to the site would be determined by the <br />• State. He explained that a decision was critical because of the existing <br />status of the real estate in the bankruptcy court. <br />Will Hanson stated that he had reservations on the Board making a <br />decision before there is a decision on Donna's Lane, on the State <br />design for the Route 28 curb cut, and the signalization of Donna's Lane <br />and Job's Fishing Road. He said the most important issue is the traffic <br />situation and considered it premature to have a decision until all of <br />the issues have been resolved. <br />Pat Coffey, Planning Board member, said traffic is a major issue. <br />Jeremy Carter, Selectman of Mashpee, said that the flea market <br />traffic is much greater than any that would be generated by McDonald's. <br />He said he understood that McDonald's is asking for guidance from the <br />Board of Appeals to proceed with the State. He said he felt the Board <br />could issue a conditional permit. He commented that the site could be <br />used for another bar. <br />Mr. Hanson responded that there is no longer a liquor license for <br />the site. He said he did not think the flea market would be a long-term <br />use of the Talanian land. He commented that he was in support of a <br />McDonald's but the issues of the traffic and lights have to be resolved. <br />BOARD OF APPEALS Minutes - September 25, 1990 3. <br />• <br />1. <br />Mr. Makunas reviewed some of the questions on the application: <br />he discussed the design of the building and Mr. Kirrane said they have <br />revised plans to meet the requirements of the Design Review Committee <br />2. <br />he reviewed the landscaping plans and Mr. Kirrane said that the plans <br />have been expanded at the request of Design Review <br />3. <br />Mr. Makunas mentioned the off-site septic system and Mr. Kirrane <br />stated that they would request an easement when Donna's Lane is taken. <br />Mr. Kirrane explained that the system would be entirely within their <br />property lines but if the road were taken some of the land for the <br />shoulders would be involved. Mr. Kirrane: suggested -a condition <br />could be included to abandon the septic system and tie into municipal <br />sewage when it is available. <br />4. <br />Mr. Makunas discussed the entrance and exit to the site.
