has been worked out. It is proposed that the existing deck be used to <br />expand the great room and kitchen in that area and add a new 12' <br />deck. A special permit is needed because the existing deck is only <br />35' from the tip of the upper fringe of the salt marsh and with <br />the new deck of 12' the addition is even more so in violation of <br />the 50 ft. setback. <br />Mr. Friel moved to grant the Special Permit. Mr. Hanrahan <br />seconded. All agreed. <br />James L. Galvin TR - Requests a Variance under Section 174-31 <br />for permission to vary the setback requirements in an R-3 zoning <br />district on property located at 12 Compass Circle (Map 105, Block 263) <br />Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, J. Friel <br />A letter was received from Richard S. Dubin, attorney for <br />the applicant, requesting that the application be withdrawn without <br />prejudice. <br />Mr. Hanrahan moved to accept the withdrawal of the application <br />without prejudice. Mr. Friel seconded. All agreed. <br />DISCUSSION <br />Michael Dunning representing Bonwood Realty Trust and Ron <br />Bonvi appeared before the Board to bring the Board up-to-date on <br />the Southport project. <br />On June 26th they appeared before the Board to request an <br />extension because Resolution Trust had taken over the lender on this <br />loan. Disbursements on the project had ceased. Mr. Bonvi has <br />been negotiating with Resolution to get them to abide to the <br />loan terms of the previous lender. The Board granted an extension <br />to December 27, 1990. <br />Mr. Bonvi is optimistic that documents will be signed shortly. <br />Mr. Friel asked if there had been any progress on the amenities. <br />Mr. Bonvi replied no. Mr. Hanrahan asked if there was any liability <br />to the town. Mr. Bonvi replied that the town had no liability. <br />When Mr. Friel suggested that Resolution Trust is running out of money, <br />Mr. Bonvi replied that this loan is approved and the money has been <br />delegated and that he did have back up financial plans. <br />The Board appreciatedthe update from Mr. Dunning and Mr. Bonvi. <br />Mr. Friel suggested they come back in November with a further update. <br />Reardon <br />hearing <br />Mr. <br />Friel moved to <br />reconsider Reardon application. Mr. <br />Hanrahan <br />seconded. All <br />agreed. <br />Mr. <br />Friel moved to <br />withdraw his original motion to deny. <br />it <br />Mr. Hanrahan <br />seconded. <br />All agreed. <br />
