James A. & Janet B. Reardon - Request a Special Permit <br />under Section 174-25.A.8 of the Zoning By-laws for permission to <br />construct an in-law apartment in an existing single family <br />• dwelling in an R-5 zoning district on property located at <br />10 James Circle (Map 71, Block 79) Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, J. Friel <br />Mr. and Mrs. Reardon explained.that a 20.1x 32'., two-story <br />addition was nearly completed. A building permit had been issued <br />and the addition had been inspected by all three inspectors. <br />Neighbors of Mr. and Mrs. Reardon, Mr. and Mrs. George Crest <br />of 9 James Circle, appeared and stated they had no opposition to <br />the Reardon's plans. <br />Mr. Makunas stated he had been contacted by Mike Ford, <br />President of the John's Pond Association. Mr. Ford told Mr. <br />Makunas that the Association was opposed to this application. <br />Mr. Ford also indicated to Mr. Makunas that there several illegal <br />apartments in the area. Mr. Makunas also stated he was contacted <br />by Mr. Weinstein, a director of the association, and Mr. and Mrs. <br />John Harris, indicating their opposition. <br />Mr. Friel asked how this application ended up at the Board of <br />Appeals. The.Reardons explained they had taken out all necessary <br />permits for the addition and upon inspection by the assistant building <br />inspector they decided to include a kitchen in the addition. They <br />were told they would have to appear before the Board of Appeals for <br />a Special Permit for an in-law apartment. <br />Mr. Makunas feels the addition, including a kitchen, is a <br />duplex. Mr. Boyd stated appearance is a large factor in determining <br />if it is a duplex., <br />Mr. Hanrahan suggested the board go out and see the project. <br />Mr. Hanrahan made a motion to take under advisement so that <br />the board members could take a look at it. There was no second. <br />Mr. Friel moved to deny the application on the grounds there was <br />a substantial change of use. Mr. Makunas seconded. Mr. Friel and <br />Mr. Makunas agreed. Mr. Hanrahan disagreed. Application denied. <br />Leon Rosenberg - (Owner of record: Leon & Marilyn L. Rosenberg) <br />Requests a Special Permit under Section 174-17 of the Zoning By-laws <br />for permission to expand a non -conforming structure with the <br />construction of house additions and deck in an R-3 zoning district <br />on property located at 127 Popponesset Island Road (Map 112, Block <br />18) Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, J. Friel. <br />Chris Costa of All Cape Survey Consultants represented the <br />applicant. This application was before the board approximately <br />six months ago for a variance. At that time there were a number <br />Of abutters opposed and the variance was denied. Since then there <br />have been numerous meetings with the abutters and an agreement <br />
