TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />October• 10, 1990 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />October 10, 1990 at 7:30 P.M. at the Mashpee Town Hall. Board <br />members present and acting throughout were: Cheryl A. Hawver, <br />Chairman; Michael A. Makunas, Vice Chairman; William J. <br />Hanrahan, Clerk; and Associate Members Edward M. Govoni and B. <br />Thomas Christian. Building Inspector• Douglas S. Boyd was in <br />attendance. <br />Ed Daly: (Owner of record: William J. Devine TR) - <br />Requests a Variance from Section 174-33 of the Zoning By-laws <br />for• permission to build within fifty (50) feet of the wetlands <br />in an R-5 zoning district on pr•oper•ty located at 9 Horseshoe <br />Bend Way (Map 48, Block 14) Mashpee, MA. <br />Ed Daly: (Owner of record: William J. Devine TR) - <br />Requests a Variance from Section 174-31 of the Zoning By-laws <br />for permission to vary the front and side setback requirements <br />in an R-5 zoning district on property located at 9 Horseshoe <br />• Bend Way (Map 48, Block 14) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Engineer John Slavinsky represented the applicant. He <br />reviewed plans of the acre lot which is primarily wetlands with <br />an 8' embankment. He reported that Conservation had required <br />placement of the house on the upland requiring variances from <br />the front and sideline setbacks as well as distance from the <br />wetlands. He explained that the topography of the lot and the <br />soil conditions created a hardship. <br />Mr•. Hanrahan moved to grant the Variances based on the <br />hardship. Mr. Makunas seconded. All agreed. <br />David and Fira Schneider: (Owner of record: Gerald J. <br />Betro) - Request a Variance from Section 174-31 of the Zoning <br />By-laws for permission to vary the setback requirements in an <br />R-5 zoning district on property located at 3 Hillside Avenue <br />(Map 49, Block 168) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Diane Thompson represented the applicants. She explained <br />that the property is under• a purchase and sale agreement and the <br />• Schneider's propose to build a single family dwelling. The lot <br />is located at the corner• of Hooppole Road and Hillside Avenue <br />with the topography sloping to Hooppole Road. She stated that <br />the plans conform to the location of houses in the area with <br />
