i Board of Appeals Minutes - October 24, 1990 4, <br />• Dr. Silva cont. <br />He explained that the family doctors being recruited by Falmouth Hospital <br />would be spending their first year in rented space at Mashpee Commons <br />but it was expected they would want to buy their own space in a year or <br />two. Dr. Silva requested an extension for two or three years and <br />Mr. Hanrahan explained that the Board could only grant a two-year <br />extension. <br />Elias McQuaid, Health Agent, said the Board of Health backs the proposal <br />and that the building will now have Town water and this eliminates the <br />need for a restriction on the number of employees. Mr. Makunas informed <br />Dr. Silva of the petition of Mashpee Commons for a medical building for <br />rental space. Dr. Silva replied that Falmouth Hospital had kept him <br />informed and felt that doctors would want to have their own space. <br />Mr. Makunas moved to grant the extension of the Special Permit for <br />two years. Mr. Hanrahan seconded. All agreed. <br />Charles L. Mack - (Owner of record: Charles L. and Margaret R. <br />Mack) - Requests a Special Permit under Section 174-25.I.9 of the <br />Zoning By-laws for an existing dock, ramp and float in an R-3 zoning <br />district on property located at 16 Bowsprit Point (Map 105, Block 225) <br />Mashpee, MA. <br />• Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Greg Taylor represented the applicant. He presented a photo of <br />the 15 -year old dock. Paul Somerville, Shellfish Constable, stated <br />he had never received plans and questioned if they had been distributed <br />to Town boards. He had no objection to the structure. There was <br />discussion of the applicant's reponsibility to submit copies to the <br />Town Boards. <br />Mr. Makunas moved to grant the Special Permit. Mr. Hanrahan <br />seconded. Mr. <br />Hanrahan seconded. All agreed. <br />McDonald's Corporation - (Advisement from September 25, 1990) <br />Members sitting: C. Hawver, M. Makunas, E. Govoni <br />Mr. Makunas moved to grant the Special Permit with conditions. <br />Mr. Govoni seconded. All agreed. The Board reserved the right to <br />amend the conditions. <br />There was discussion of requesting an opinion from Town Counsel <br />on charging legal fees to applicants if litigation results from a decision <br />of a Town Board. <br />
