r <br />,f <br />MASHPEE BOARD OF APPEALS <br />Minutes <br />Wednesday, November 14, 1990 <br />The Mashpee Board of Appeals held a meeting at 7:30 P.M. on <br />Wednesday, November 14, 1990 at the Mashpee Town Hall. Board members <br />present and acting throughout the public hearings were Cheryl A. Hawver, <br />Michael A. Makunas, William J. Hanrahan and Edward M. Govoni. Members <br />John J. Friel and B. Thomas Christian were absent. Messrs. Makunas and <br />Govoni stepped down from the Board for the discussion. <br />Ms. Hawver called the meeting to order at 7:35 P.M. <br />PUBLIC HEARINGS <br />Mark Eynation - (Owner of record: B. Kenneth & Ruth H. Eynation) <br />Requests a Special Permit under Section 174-17 of the Zoning By-laws <br />for permission to expand a non -conforming use with the construction <br />of a single family residence in an R-3 zoning district on property <br />located at 51 Uncle Edwards Road (Map 117, Block 221) Mashpee, MA. <br />Mark Eynation - (Owner of record: B. Kenneth & Ruth H. Eynation)- <br />Requests a Variance under Section 174-31 of the Zoning By-laws for <br />permission to vary the setback and lot coverage requirements in an <br />R-3 zoning district on property located at 51 Uncle Edwards Road <br />(Map 117, Block 221) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Engineer David Sanicki represented the applicant. He explained that <br />an earlier plan had been revised to reduce the size of a proposed house <br />and move it further from the abutter's lot line. It is now 15' from the <br />neighbor. The other side line abuts a paper street. <br />Mr. Hanrahan read comments from abutters objecting to the plans and <br />Mr. Makunas stated that he had received a telephone call from an abutter <br />objecting to the plans. There was discussion of the requested lot <br />coverage of 22.3% and Mr. Sanicki said house and deck had been reduced. <br />Mr. Sanicki said he could amend the plans to further reduce the size of <br />the house to comply to the 20% in the by-laws. <br />Mr. Sanicki informed the Board that the side -line variance would be <br />required adjoining the paper road. V. Kenneth Eynation, the applicant's <br />brother, stated that he was the closest abutter on the Westwood Road <br />side and that he had discussed the plans with New Seabury who owns the <br />immediately abutting lot and they had no objections, Mr. Makunas asked <br />if everyone in the neighborhood conformed to the 25' front setback and <br />Mr. Eynation said most of the houses were 20 - 25' but some were much <br />closer to the road. Mr. Hanrahan and Mr. Makunas suggested that revised <br />plans be reviewed with abutters. Mr. Govoni asked about the owner of the <br />paper road and Mr. Eynation said New Seabury owned it and had no objection. <br />
