BOARD OF APPEALS <br />0 MINUTES <br />SPECIAL MEETING - March 22, 1989 <br />At 7:00 p.m. on Wednesday, March 22, 1989 the Mashpee Board of <br />Appeals held a Special Meeting at the Mashpee Town Hall. Board members <br />present and acting throughout were: William J. Hanrahan, Cheryl A. Hawver, <br />Richard E. Halpern and Edward M. Govoni. <br />Charles D. Spohr - (Owner of Record: Henry N. and Elizabeth B. Spohr, TR <br />Requests a Special Permit under Section 6.3.I.9 of the Land Use Requirements <br />for permission to construct a boardwalk in an R-3 zoning district on property <br />located at 29 Hamblin Road (Map 120, Lot 32) Mashpee, MA. <br />Members sitting: William Hanrahan, Cheryl Hawver, Richard Halpern <br />1� This hearing was continued from January 25, 1989. Mi. Halpern explained <br />that the hearing had been continued due to the fact that Mr. Spohr had not <br />submitted plans to the Conservation Commission and the Shellfish Commission <br />prior to the January meeting. Mr. Spohr confirmed that plans had now been <br />submitted. <br />Mr. Hanrahan read a letter from the Shellfish Commission dated March 1 <br />• stating that they had no objections to the planned boardwalk. He also <br />read a letter from Louise Behrman, Vice Chairman of the Conservation <br />Commission, stating that Conservation had no objection to the plan as long <br />as there are no docking facilities planned. <br />Paul Somerville, Shellfish Constable, questioned discrepencies in the <br />plan. He noted that the walkway was designated as a 4' width but the <br />detailed drawing indiciated a width of 5'8". He also asked for detail <br />on plans for the end of the boardwalk. Mr. Spohr explained that the <br />walkway width is a nominal 4' between railings but that framework and <br />planks used will be a total width of 5' or more. <br />Mr. Hanrahan stated that plans dated 2/2/89 were the basis for the <br />hearing and they did not include detail for any additional structures <br />at the end of the walkway. <br />William Anderson, an abutter, questioned why the proposed house was <br />located in the corner of the lot when the property had frontage of 240'. <br />Mr. Halpern explained that the Appeals Board was hearing the request for <br />a boardwalk only and that placement of the house would be reviewed by the <br />Building Inspector and had to meet zoning set -back guidelines. <br />William Moore, an abutter, asked about 100 year flood plain restrictions. <br />Ms. Hawver explained that the Board of Health and the Building Inspector would <br />be reviewing the restrictions. <br />• Mr. Helpern moved to grant the Special Permit for an elevated walkway <br />4" x 40" as per revised plan dated 2/2/89. Ms. Hawver seconded. All agreed. <br />Meeting adjourned 7:20 p.m. <br />
