Board of Appeals Minutes - April 12, 1989 Page 3. <br />• Charles D. Spohr (cont.) <br />Joel Kanter, a direct abutter, presented written comments in opposition <br />to the petition . He stated that the property is comprised of illegal <br />fill and the proposed construction would disrupt the fragile ecosystem <br />in this wetlands area. <br />Kate Perry of the Seconsett Island Association spoke in opposition <br />to the petition. She stated that she represented 70 members of the Association, <br />many of whom were present. She said the area is in a flood plain and <br />could be polluted from storage of oil or paint. She had understood that <br />the boathouse would be involved in the sales and servicing of boats. <br />Mr. Makunas informed her the petition was for private use only. Mr. Boyd <br />explained that the word "marina" had been used since that is the term <br />used in the zoning by-laws. <br />Ms. Perry questioned the depth of the water'at the site and said there <br />was not enough water at low tide for a small dinghy. Stephen Perry, an <br />abutter, stated that the depth of water was sufficient only for canoes. <br />Donald Bourne presented copies of documents outlining the wetlands <br />restrictions and pictures taken at low tide showing mud flats. He questioned <br />the figures on the depth of water which were shown on the plans. <br />Paul Sommerville, Shellfish Constable, read comments in opposition <br />• to the plans. He opposed the location and size of the float and discussed <br />the shallow waters in the area. <br />Mr. Makunas asked Mr. Spohr if he had personally measured the water <br />depth information on the plans. Mr. Spohr said Joseph Harvey, a surveyor, <br />had measured the depth at high water. He had followed the D.E.Q.E. definitions <br />of highwater. <br />Mr. Makunas noted that the plan stated "6 feet of water at mean low <br />water". Mr. Spohr said that this was an error. Mr. Makunas asked <br />Mr. Somerville the tidal range in the area. Mr. Sommerville said there <br />was a 2}' range. <br />Mr. Govoni asked Mr. Sommerville if he agreed with the high water figures <br />on the plan. Mr. Sommerville said he did not. <br />Mr. Makunas questioned the accuracy of the plans. Mr. Spohr asked <br />if the.hearing could be continued until the depth of the water was checked <br />Jane Evans of the Citizens for the Protection of Waquoit Bay asked <br />if members of the Board would view the site. Ms. Hawver stated that all <br />members had visited the site. <br />Ms. Hawver stated that there were 13 letters in opposition received <br />from abutters. She read comments from V. Louise Behrman, Vice Chairman <br />of the Mashpee Conservation Commission, opposing the petition. <br />• <br />
