MASHPEE BOARD OF APPEALS <br />MINUTES <br />MAY 24, 1989 <br />The Mashpee Board of Appeals held a meeting at the Mashpee Town <br />Hall on Wednesday, May 24, 1989 at 7:30 p.m. Board members present <br />and acting throughout were: William J. Hanrahan, Cheryl A. Hawver, <br />Richard E. Halpern and Edward M. Govoni. Michael A. Makunas arrived <br />at the meeting at 9:40 p.m. Mr. Douglas Boyd, Building Inspector, <br />was in attendance. <br />Little River Boatyard, Inc. - (Owner of record: William E. Burtis) <br />Requests a Special Permit under Sections 5.1, 6.2 and 6.3 of the <br />Zoning By-laws for permission to change a non -conforming structure <br />in an R-3 zoning district on property located at 15 Riverside Road <br />(Map 119, Block 88) Mashpee, MA. <br />Members sitting: W. Hanrahan, C. Hawver, R. Halpern <br />Ms. Virginia Driscoll, an abutter, stated that she would like <br />to challenge the right of Mr. Halpern to sit on this hearing. Mr. <br />Hanrahan asked on what grounds she was challenging. She replied <br />that she had spoken to Mr. Halpern on the phone and believes he <br />• is biased in favor of the petition. She explained that he said some <br />neighbors were denying Mr. Burtis the right to be successful in <br />his venture. <br />Mr. Halpern responded by saying he did not believe he had any <br />bias, he was not an abutter, he had no financial interest and had <br />never done business with the boatyard. He said he had given Ms. <br />Driscoll information as a Board of Appeals member since she had <br />several questions on procedures. <br />Ms. Kathleen Perry, 29 Riverside Road, also challenged the <br />right of Mr. Halpern to sit on the hearing. She reported that she <br />had received a phone call from Mr. Halpern on April 29 in which <br />she claimed he said he thought it was ridiculous that all of this <br />was coming up. <br />John Read, 45 Riverside Road, commented that area residents <br />were not being objective about the situation. An unidentified member <br />of the audience stated that everyone in the room had a different <br />opinion. <br />Ms. Perry requested a copy of the minutes of the meeting and <br />was informed that she should submit the request in writing. <br />Mr. Hanrahan stated that unless there was demonstrable financial <br />• conflict of interest under the statute he saw no reason that Mr. <br />Halpern could not sit on the hearing. He explained that there are <br />definite procedures for appeals if anyone is aggrieved by the decision <br />of the Board. He asked that the objections be noted in the record. <br />
