Board of Appeals Minutes -July 23, 1997 4. <br /> Mashpee Commons Limited Partner"tu -Requests a Modification of Special Permit 97- <br /> 11 filed with the Town Clerk on February 5, 1997 for the construction of Building I IB at <br /> Mashpee Commons for clarification of the use of 13,700 square feet of first floor space for <br /> retail, office or restaurant use and 13,500 square feet of second floor space for 13 <br /> apartments for residential use. The property is located in a C-1 zoning district at 38 <br /> Nathan Ellis Highway (Map 74, Block 20)Mashpee,MA. (Owner of record: Fields Point <br /> Ltd. Partnership). <br /> Members sitting: E. Govoni, C. Hawver, M. Makunas <br /> Mr. Regan stepped down for this hearing. Douglas Storrs represented the applicant and <br /> presented the Board with the revised plan for building I IB. He explained in Special <br /> Permit 97-11 he had requested 13,700 sf for retail and 13,500 for residential use but his <br /> bank requires documentation on the number of residential units. He requested clarification <br /> of 13,500 square feet representing 13 residential units. <br /> He reviewed the 1986 Special Permit which granted 100 residential units and they <br /> assigned units to each of the proposed buildings. He said the 1989 permit transferred 9 <br /> units from Building 15 and assigned them to Building 11. He said it was to the Board's <br /> pleasure in how this is handled. Mr. Govoni said he preferred to keep track of the 100 <br /> units by building. Mr. Stony said he would like to transfer 4 units from Building 19 to <br /> Building I 1 leaving a balance of 6 residential units in Building 19. Mr. Govoni stated that <br /> this would correct the one unit error in the addition. The units resulting will be: <br /> Building I IB 13 Building 18 17 <br /> Building 16 9 Building 19 6 <br /> Building 17 8 Building 21 8 <br /> Building 20 18 Building 24 12 <br /> Building 22 9 <br /> Mr. Govoni moved to grant the Special Permit. Mr. Makunas seconded. All agreed. <br /> Cooke's Restaurant- The Board received a request for the release of the $10,000 <br /> landscape bond. Mr. Hauck suggested that $8,000 be released since there was still some <br /> work to be done. Mr. Govoni moved to release $8,000,Mr. Regan seconded. Ms. <br /> Hawver made the vote unanimous. <br /> Honadew Donuts -Mr. Govoni stated that that they had not posted:the $5,000 landscape <br /> bond nor had they done the work. He said he thought Bill Hauck should enforce the <br /> Permit and cite him for non-conformance. It was agreed that the Chairman should send a <br /> memo to Bill Hauck requesting enforcement. <br /> Minutes -Mr. Govoni moved to accept the Minutes of May 14,May 28 and June 25, <br /> 1997.
