Mr. Makunas opened the meeting for <br /> public comments: <br /> Tom Mackey: he said he now owns the road. He said he had to get easements for his lots <br /> and asked where water and power were going. He asked who was going to maintain the <br /> road and pick up the trash. Mr. Kirrane said they can only control the section on their <br /> land. <br /> Anne Shaw: Deerfield Acres Trust: said she was concerned with safety. She said she <br /> understood that the Fire Chief needed a road paved all the way and not just by these lots. <br /> She said she did not think this was the primary access to Peter's Pond and that people <br /> used Cotuit Road. Ms. Shaw said she would prefer a cluster subdivision to preserve the <br /> wildlife and she questioned how many graves were on the site. Mr. Kirrane responded <br /> that they will work with the state to preserve the graves. <br /> Alec Watt: asked which section of the by-law was the subject of the previous variance <br /> and Mr. Kirrane responded 174-32. He asked if they need an easement to improve the <br /> road? Mr. Kirrane said Mr. Mackey has the responsibility to keep the road clear and <br /> maintain the width and his client will take care of the road north of that. Mr. Mackey <br /> needed an easement to go onto Mr. Doyle's lot to cut brush. <br /> James McGonigle: asked what is the width of the road entrance and Mr. Makunas <br /> responded that it was 20 feet. Mr. McGonigle said that the comer was dangerous and he <br /> was concerned with public safety. <br /> K. Kirrane: the issue is suitability of access and we think it makes more sense to access <br /> from John Ewer Road. <br /> Anne Shaw: questioned if they would be paving all of the way to Pimlico Pond Road or <br /> to the beginning of Mr. Mackey's property? Mr. Makunas said the paving would.be to <br /> Mr. Mackey's property. Mr. Kirrane said they only control the portion of road on their <br /> property. Ms. Shaw replied that the Fire Chief had requested paving for his vehicles and <br /> Mr. Kirrane said the first hundred feet of the roadway is a dead issue because it had a prior <br /> permit. Mr. Dorgan said that part of the road is covered by an existing Variance. Mr. <br /> Makunas said the Board cannot enforce anything that is not before it. <br /> Mr. Makunas read a memo from Greg Taylor saying the road would be plowed and kept <br /> clear if houses were built on it. Mr. Mackey asked if school buses would go on a dirt <br /> road. Mr. Mrrane said his client would work with Mr. Mackey and Mr. Doyle to improve <br /> the first part of the road. There was discussion of danger to the children boarding a bus <br /> on Pimlico Pond Road. <br /> Alec Watt: is this subject to the subdivision control law? Mr. Kirrane replied that it was <br /> not and would be an ANR plan. Mr. Watt asked why the ANR had not been done and <br />
