Board of Appeals Minutes - April 22, 1998 g <br /> Michael Barrows, a neighbor, stated his concern on the increases in traffic. Mr. Elhinney <br /> said they would try to have access to the subject lots through Willowbend and would <br /> work with the neighbors to improve conditions. Nancy Barrows said there are three day <br /> care centers in the area and they do not want increases in traffic. <br /> Mr. Nelson stated that the plans should indicate the derivation of the lots and Mr. Govoni <br /> said that they should have shown the original subdivision by dotted lines on the ANR plan. <br /> Mr. Guerrera said they should have shown a base line on the plans. Mr. Nelson stated that <br /> they needed a reference plan. Mr. Besse suggested they would provide a reference plan <br /> and Mr. Elbinney asked if they should record the plan. Bill Hauck stated that he has the <br /> limit of 20% growth and that variances lapse after 1 year with a 6 month extension. Mr. <br /> ENnney questioned if the variance was in effect if the lots were sold. There was <br /> discussion of renewal of variances on Sunset Strip and James Circle. Mr. Govoni <br /> questioned if the variance should be given for the entire subdivision but Bill Hauck said <br /> this would apply only for Special Permits for definitive subdivisions from the Planning <br /> Board. Mr. Hauck said this was beyond written zoning and would require legal opinions <br /> if a subdivision could have a variance. <br /> Mr. ENnney said there is conflict between the phasing by-law and the time limit of the <br /> variance. Mr. Hauck suggested Town Counsel attend a meeting. Mr. Govoni suggested <br /> an extension in the hearing calendar so that hearings can be continued. Mr. Elhinney said <br /> the proposed deed includes identification of the lots in the subdivision plan and referencing <br /> the new lots on the ANR plan. He suggested that Charles Rowley, the Planning Board <br /> engineer, meet with the board. Mr. Elhinney said they would be happy to grant a 60-day <br /> extension but would have to check the time restrictions on the Buy and Sell.. <br /> Mr. Govoni stated that the Board should get an opinion on the life of the Variance. Ms. <br /> Hawver moved to continue to May 27. Mr. Nelson seconded. All agreed. <br /> Wendy Long -Ms. Hawver moved to allow withdrawal. Mr. Guerrera seconded. All <br /> agreed. <br /> Litvack -there was no quorum for this hearing. <br /> Women's Body Shopv Inc -Requests a Special Permit under Sections 174-25.B.11, 174- <br /> 25.B.14, 174-25.E.1, 174-25.E.4, 174-25.H.6 and 174-25.I.7 for a health club including <br /> facilities for exercise classes, swimming pool and aquatics, diet counseling and dance on <br /> property located in a C-2 zoning district at 502 Main St. (Map 27, Block 24)Mashpee, <br /> MA.
