(Owner of record: <br /> Anthony J. LaCava, Tr.) <br /> Prime Properties Limited Partnership - Requests a Special Permit under Section 174-31 of <br /> the Zoning By-laws for permission to modify the lot size on property located in an R-5 <br /> zoning district at 583 Great Hay Road (Map 67 Block 53)Mashpee, MA. (Owner of <br /> record: Anthony J. LaCava, Tr.) <br /> Members sitting: Edward M. Govoni, Robert G. Nelson and James M. Dorgan. <br /> Kenneth Marsters represented the applicant, Anthony LaCava. He stated that Great Hay <br /> Road was shifted approximately eight feet in order to remain on Mr. LaCava's property. <br /> This was done to avoid an issue over ownership between the Town and Mr. LaCava. <br /> There are now two roads for residents to access. When the road was shifted, <br /> approximately 200 square feet was removed from a corner of one lot, and 4000 square <br /> feet from the other lot. Mr. Marsters stated that the Planning Board has seen the <br /> proposed plans. Mr. Govoni required Mr. Marsters to submit detailed plans for the layout <br /> of the lots. <br /> Mr. Allen Morris, an abutter, expressed concerns that headlights would be coming into his <br /> living room with the road being moved. Mr. Govoni stated that the road was going to be <br /> completed by the Town regardless of the applicant's request for Special Permits. <br /> Mr. Dorgan moved to grant the Special Permit for 3 Snead Drive, referencing the <br /> Mashpee Planning Board plan Phase 3 Modification, dated 5-28-98. Mr. Nelson <br /> seconded. All agreed. <br /> Mr. Dorgan moved to grant the Special Permit for 583 Great Hay Road, referencing the <br /> Mashpee Planning Board plan Phase 3 Modification, dated 5-28-98. Mr. Nelson <br /> seconded. All agreed. <br /> CONTINUED HEARINGS: <br /> Brickyard Marketplace Nominee Trust- Requests a Variance from Sections 174-11 and <br /> 174-31 of the Zoning By-laws for permission to vary the setback requirements on <br /> properties located in C-2 and R-5 zoning districts at 93 Old Brickyard Road (Map 72, <br /> Block 22) and 439 Nathan Ellis Highway (Map 72, Block 23) Mashpee, MA. (Owner of <br /> record: Henry C. Labute). <br />
