Board of Appeals Minutes - September 23, 1998 6.
c
Brickyard Marketplace Nominee Trust -Requests a Special Permit under Sections 174-
25.D.1, 174-25.E.1, 174-25.E.2, 174-25.E.4 and 174-25.H.6 of the Zoning By-laws for
use for retail businesses on properties located in C-2 and R-5 zoning districts at 93 Old
Brickyard Road (Map 72, Block 22) and 439 Nathan Ellis Highway(Map 72, Block 23)
Mashpee, MA. (Owner of record: Henry C. Labute).
Members sitting: James E. Regan III, James M. Dorgan and Robert G. Nelson.
Michael Grotzke of the Phoenix Group represented the applicant with revised plans that
will be submitted for approval from the Design Review Committee on October 14, 1998.
He stated that requests brought up at the August 12, 1998 Board of Appeals meeting have
been included in the revised plans. Some of the requests included:
• left-hand turn only signs at the exits.
• septic system moved to the front of the lot.
• widen and repave the road back to service entrance of the lot.
• lighting concentrated on the front of the property.
• wooden fence to provide screening.
• remove H-6 zoning.
Mr. Regan reminded Mr. Grotzke that a 7-foot fence was requested. He also addressed
the issue of"no parking" signs. Mr. Grotzke informed the Board that the Police Chief
was consulted and he stated that the abutters must petition the Board of Selectmen for"no
parking signs"to be installed. The Board of Selectmen will then submit the petition to the
Police Department. Mr. Grotzke clarified that berm will be installed.
Mr. Nelson stated that the plan submitted is incorrect according to Land Court Plan
11380N, dated October 12, 1967. He reminded Mr. Grotzke the Board secretary had
advised him of the discrepancy that affects the dimensioning of the plan. Mr. Grotzke told
the Board secretary to call the surveyor, which she did. However, the correction was not
made.
Comments from, an abutter, Mr. Labute indicated that he is satisfied with the changes.
Mr. Shute, an abutter, claimed that traffic in the neighborhoods will increase if the roads
are improved. The owners, Mr. and Mrs. Berish, expressed concern that repaving the
entire road will put an undue and unfair burden on them. He stated that the proposal is a
relatively small project compared to a large shopping center.
Mr. Hauck stated that Design Review has not received any landscaping plans, which are
required two weeks in advance of the meeting. He also pointed out that it is up to the
applicants to submit the correct plans for the Board to review.
