i <br /> Section 4.5. 12 No motorized Vehicles on Beaches. All <br /> morotized vehicles, including but not <br /> limited to all oversand dune buggies, beach <br /> buggies, motorcycles, motorized bicycles <br /> and trailers as defined in Section 4.2.3 <br /> of this chapter of the by-taws, are <br /> prohibited at all times from all banks, <br /> beaches, dunes and shores bordering on <br /> the ocean or any bay, creek , river , stream, <br /> pond, marsh and lake in the Town of Mashpee <br /> except for emergency vehicles and official <br /> vehicles of the Town or Commonwealth . On <br /> any land subject to tidal action , coastal <br /> storm, flowage , or flooding, the <br /> i Conservation Commission shall have <br /> discretionary authority to grant an <br /> exception to the operation of this by-law <br /> to any property owners who can establish <br /> hardship and who can demonstrate that no <br /> substantial harm will occur to the subject <br /> land because of the proposed usage of <br /> motorized vehicles. Any exception <br /> granted by the Conservation Commission <br /> shall be limited to such terms and <br /> conditions of usage as is determined by <br /> said Commission as necessary to preserve <br />:I the land and the bordering waters. Any <br /> person violating the provisions of this <br /> i <br /> by-law shall be punished by a fine not <br /> to exceed $50 .00 for each offense . <br /> Section 4.5. 13 Foot Races. <br /> i <br />! Competitive foot races may be held on <br /> public ways provided that such races are <br /> sponsored by or in cooperation with <br /> organized athletic recreational or <br /> charitable organizations, and further• <br /> provided that the sponsoring organization <br /> shall first obtain a permit from the Board <br /> i <br /> of Selectmen to conduct the foot race . <br /> There shall be a fee of $25 ( twenty-five <br /> dollars) for said permit . <br /> The sponsoring organization shall apply <br /> j to the Board of Selectmen in writing for <br /> the permit and shall include in the <br /> application the routes to be followed, <br /> the travel lanes to be occupied by runners, <br /> locations or checkpoints and refreshement <br /> stops, arrangements made for police traffic <br /> control officers and/or rescue units as <br /> required by the Police Chief and Fire Chief <br /> respectively. <br /> -60- <br /> I <br />
