Section 4.5.11 HAW S, PEDDLERS AND TRANSIENT VENDORS <br /> A. For the purpose of this by-law the definition of hawkers, <br /> peddlers and transient vendors shall be the same as those <br /> contained in Sections 1 and 13 of Chapter 101 of M.G.L. <br /> B. No person shall hawk, peddle or expose for sale or barter <br /> any foods, wares, periodicals or merchandise from any wagon <br /> or vehicle or door-to-door without first obtaining a license <br /> from the Director of Standards in accordance with the provisions <br /> of Chapter 101 of M.G.L. and frau the Chief of Police in <br /> accordance with this by-law. The fee for such licenses shall <br /> be in conformance with Chapter 101, Section 22, M.G.L. <br /> C. No hawker or peddler shall expose for sale any foods, <br /> beverages, fruits, vegetables, fish, meats, dairy products, <br /> ice cream, frozen desserts or confections until the vehicle <br /> or receptacle has been inspected and approved by the Board <br /> of Health Agent. Vehicles utilized for the selling of frozen <br /> desserts or confections must have installed an amber flashing <br /> light visible from the front and rear of the vehicle and such <br /> light must be flashing when vehicle is stopped for the purpose <br /> of selling. <br /> D. Any person licensed under this by-law shall display the <br /> license by affixing it in a prominent place to his outer garment. <br /> E. No person licensed under this by-law shall engage in the <br /> activities described in paragraph 2 of this by-law in any manner <br /> as to impede foot or vehicular traffic along or to a public way <br /> or public sidewalk or any access road or driveway. No person <br /> while engaged in such activities shall remain stopped or standing <br /> in any one place or within 200 feet thereof for more than fifteen <br /> (15) minutes, unless continuously engaged in transactions. <br /> F. No hawker or peddler shall sell or offer for sale any foods, <br /> wares or merchandise on any street of the Town within 500 feet <br /> of the Mashpee Middle School or grounds thereof on days when <br /> the public school is in session, nor shall any activity be <br /> engaged in on a street or sidewalk so as to imide the free <br /> flow of vehicular or pedestrian traffic. In addition, the <br /> Chief of Police or any of his agents may restrict sales in any <br /> location within the 'Town that is determined to be a safety <br /> hazzard to pedistrian or vehicular traff4c. <br /> G. When a street or streets are closed to vehicular traffic <br /> within the Town for the purpose of a parade, no hawker or <br /> peddler may conduct business within the curb lines of said <br /> streets during the hours the streets are closed. <br /> H. The provisions of this .section shall r-:t apply to any <br /> person conducting a "garage sale" nor to any person who goes <br /> door-to-door to sell goods, wares, periodicals, or merchandise <br /> on behalf of any group or organization for any of the purposes <br /> described in Chapter .180, Section 2, of the M.G.L. <br /> I. Whoever violates the provisions of this section shall be <br /> punished by a fine of $300 (three hundred dollars) and each day <br /> a violation occurs shall be considered a separate offense. <br /> -26 <br />
