Section 4.5.12 No Motorized Vehicles on Beaches. <br /> All motorized vehicles, including but not limited to all oversand <br /> dune buggies, beach buggies, motorcycles, motorized bicycles and <br /> trailers as defined in Section 4.2.3 of this chapter of the by-laws, <br /> are prohibited at all times from all banks, beaches, dunes and <br /> shores bordering on the ocean or any bay, creek, river, stream, pond, <br /> marsh and lake in the Town of Mashpee except for emergency vehicles <br /> and official vehicles of the Town or Commonwealth. On any land <br /> subject to tidal action, coastal storm, flowage, or flooding, the <br /> Conservation Commission shall have discretionary authority to <br /> grant an exception to the operation of this by-law to any property <br /> owners who can establish hardship and who can demonstrate that no <br /> substantial harm will occur to the subject land because of the <br /> proposed usage of motorized vehicles. Any exception granted by <br /> the Conservation Comnission shall be limited to such terms and <br /> conditions of usage as is determined by said Cc mission as necess- <br /> ary to preserve the land and the bordering waters. Any person <br /> violating the provisions of this by-law shall be punished by a <br /> fine not to exceed $50 (fifty dollars) for each offense. <br /> ion 4.5.13 Foot Races. <br /> Competitive foot races may be held on public ways provided that <br /> such races are sponsored by or in cooperation with organized <br /> athletic recreational or charitable organizations, and further <br /> provided that the sponsoring organization shall first obtain a <br /> permit from the Board of Selectmen to conduct the foot race. <br /> There shall be a fee of $25 (twenty-five dollars) for said permit. <br /> The sponsoring organization shall apply to the Board of Selectmen <br /> in writing for the permit and shall include in the application <br /> the routes to be followed, the travel lanes to be occupied by <br /> runners, locations of checkpoints and refreshment stops, arrange- <br /> ments made for police traffic control officers and/or rescue units <br /> as required by the Police Chief and Fire Chief respectively. <br /> The Board of Selectmen is authorized and empowered to make and adopt <br /> such regulations as it may deem reasonable and appropriate to secure <br /> the safety of the participants in the race, motorists using the <br /> public ways, and the inhabitants of the Town. <br /> The provisions of this by-law shall not be applicable to any foot <br /> race sponsored by the School Comnittee or the Parks and Recreation <br /> Department. <br /> Any violation of the provisions of this subsection shall be <br /> punished by a f-ine of not more than $100 (one hundred dollars) . <br /> I <br /> r <br /> -26,r- <br />
