Article 4. 7 The Use of Waterways , Ponds and Lakes <br /> Section 4. 7. 1 Speed Regulations . <br /> a. No person shall operate a motor boat , as de- <br /> fined in Chapter 90B of the Massachusetts General <br /> Laws , on the ponds of Mashpee within 150 feet of <br /> shore at a rate of speed in excess of 6 miles per <br /> hour. No person shall operate a motor boat in <br /> any area of any pond at a speed greater than <br /> 6 miles per hour during the period from one hour <br /> after sunset to one hour before sunrise . <br /> i <br /> b. Speed shall not exceed 6 miles per hour and <br /> no wash shall be created in posted areas nor within <br /> 150 feet of bathers , divers , small vessels pro- <br /> pelled by means other than machinery , vessels not j <br /> underway , or commercial or private docking or <br /> i <br /> mooring areas . <br /> i <br /> Section 4 . 7. 2 Pollution . The discharge or disposal (by motor- i <br /> boat operators or passengers ) of oil , dead fish , <br /> waste , rubbish , debris or sewage in the waters , <br /> shores or foreshores is prohibited. <br /> i <br /> Section 4 . 7. 3 Moorings . <br /> a. The locations , type and adequacy of every <br /> mooring must be approved by the Harbormaster or <br /> Assistant Harbormaster before placement . Any mooring <br /> may be inspected , removed or relocated whenever , in I <br /> the judgement of the Harbormaster or Assistant <br /> Harbormaster , the safety of the other vessels or <br /> properties , or maximum use of the area requires such <br /> action . The expense of such inspection , removal , <br /> or relocation shall be the responsibility of the <br /> owner. <br /> b. Each mooring buoy shall be painted white with <br /> a visible blue band which can be seen from a minimum <br /> distance of 150 feet and shall be identified by the <br /> owner' s name and/or designated number. <br /> d. Whereas lobster pots , crab pots , conch or welk <br /> pots , eel pots , or other similar devices may be a <br /> hazard to navigation or restrict recreational use <br /> of water, permission of the Harbormaster must be <br /> obtained prior to their placement . Any such device <br /> placed without such permission may be summarily removed <br /> by the Harbormaster without notice or hearing, if he <br /> determines the same to be hazardous to navigation <br /> or restrictive of recreational use of the water. <br /> Said device may be disposed of as provided for in <br /> Section 4 . 7. 4 of this by-law.
