FORM M 444 0.1-44-55 BURIED CABLE AGREEMENT CITY/TOWN WHEREAS by an order of the Board of Selectmen of the-City/Town of Mashpee , Massachusetts, dated March 15, 1967 , permission has been granted to the NEW hlENGLAND TELEPHONE AND TELEGRAPH COMPANY to place and maintain buried cable,/m edestalsholes, with the wires and cables therein, markers and other fixtures in or under the surface o�: Mashpee Neck Road as referred to in said order, to which order reference may be had, NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that said NEW ENGLAND TELEPHONE AND TELEGRAPH COMPANY in consideration of the premises and in compliance with the terms and requirements of said order, doth hereby for itself and its successors and assigns, covenant and agree to and with the said GityfTown of Mashpee asfollows :- 1. That said Company shall indemnify and save harmless the said-Gity/Town against all damages, costs and expense whatsoever to which the 943 -/Town may be subjected in consequence of the acts or neglect of said Company, its agents or servants, or in any manner arising from the rights and privileges granted it by the GiSy�Town. 2. That said Company will before a street is disturbed for the laying of its cables execute its bond in a penal sum of Five Thousand Dollars ( $5, 000 ) (reference being had to the bond already on file with said CUy/Town) conditioned for the faithful performance of this agreement and of its duties under said permit.
