provided, that there shall be excluded in computing said one (1) <br /> year period any period during which the granting of any such permit <br /> or approval is being appealed or otherwise contested. In the event <br /> construction of the PRC has not been substantially completed ten <br /> (10) years from the date that all such permits and approvals have <br /> been obtained, computed as set forth above, then the developer shall <br /> reapply for approval for the remaining undeveloped area under this <br /> Section 9.5. <br /> 9.59 Miscellaneous. <br /> 9.591 The Building Inspector may revoke a building permit issued <br /> under this By-Law in case the builder or developer fails to conform '!' <br /> to the plans and schedules as approved. <br /> 9.592 If any provisions of this Section 9.5 shall be found to con- <br /> flict with any other provision of this By-Law, such conflict shall r , <br /> be resolved in favor of this Section 9.5. f, <br /> �a I <br /> 9.593 If any section, subsection, or other portion of this Section <br /> 9.5 shall be adjudged invalid, the remainder of this Section 9.5 <br /> shall be deemed not to be affected thereby and shall continue to . <br /> be in full force and effect. E <br /> 9.6 DESIGN REVIEW COMMITTEE - A Design Review Committee shall be established to <br /> advise the Planning Board and Board of Zoning Appeals on matters of archi- <br /> tectural and design concern in the review of applications for special permits <br /> for developments in the R-4, C-2, I-1, C-1, C-1-SV Incentive, and C-1-0 <br /> Incentive Zoning Districts. Architectural and design concern shall include <br /> but not be limited to: site planning, building placement, building size, r <br /> design compatibility, exterior appearance, construction materials and finishes, <br /> parking and roadways, landscaping and site grading, building entrance and <br /> exit placement and signs. ! ! <br /> The Design Review Committee will sit with the Planning Board and Board of P ' <br /> Zoning Appeals in any public meetings dealing with development proposals in <br /> the R-4, C-2, I-1, C-1, C-1-SV Incentive, and C-1-0 Incentive Zoning Districts. ; <br /> The Design Review Committee may call special meetings of its own to review 's <br /> applications. Findings of the Design Review Committee shall be advisory to € a " <br /> the Planning Board and Board of Zoning Appeals. Full power for granting or arty <br /> denial of applications for special permits shall remain with these Boards. ! <br /> Membership of the Design Review Committee shall consist of three persons. . <br /> one each from the Planning Board and Board of Zoning Appeals and a third y <br /> member to be appointed by the Board of Selectmen. The Planning Board member rl9 <br /> shall be appointed by the Planning Board Chairman, and the Board of Zoning 4 : !, <br /> Appeals member shall be appointed by the Chairman of the Board of Zoning f {� � <br /> Appeals. The third member of the Design Review Committee shall be an k` <br /> architect, landscape architect or professional civil engineer registered in { <br /> the Commonwealth of Massachusetts.
