Town Meeting, September 22, 1986, approved <br /> by Attorney General , January 7, 19877 . <br /> Section 4.7.4 Abondonment . a. No vessel , mooring, or <br /> other object shall be abandoned, sunk or <br /> otherwise placed where it may constitute <br /> a danger to navigation . Any vessel , <br /> mooring or object so placed, or any vessel <br /> improperly secured, swamped, sunk , washed <br /> ashore or found in a restricted area must <br /> be removed and relocated by the owner at <br /> the direction of the Harbormaster or an <br /> Assistant Harbormaster . If corrective <br /> action is not taken after 72 hours notice <br /> to the owner , or if the owner is not known , <br /> after notice has been posted for the same <br /> period at the Mashpee Town Hall , or on or <br /> near such vessel , mooring or object , the <br /> Harbormaster or Assistant Harbormaster may <br /> take corrective action . The expense of <br /> such removal or relocation and any <br /> liability incurred therefor shall be the <br /> responsibility of the owner . <br /> b. In the event that the owner of a <br /> vessel , mooring or other object which has <br /> been abondoned, or otherwise placed where <br /> it will constitute a danger to navigational <br /> or public safety, in violation of Section <br /> 4.7.4a, the Harbormaster , after having <br /> removed same pursuant to the foregoing <br /> section , shall give notice to the owner , or <br /> if the owner is not known , at ter notice has <br /> been posted at Mashpee Town Hall , or on , <br /> or near the vessel , mooring or object , that <br /> he intends to sell at public auction the !' <br /> property removed unless claimed within 90 <br /> days of posting of said notice of intent <br /> to sell . All proceeds from said sale shall <br /> be used to defray the cost and expenses of <br /> removing, giving of notice or notices, and <br /> sale , and the balance of the proceeds shall <br /> be turned over to the owner or held by the <br /> Town Treasurer subject to claim by the <br /> owner if the owner is unknown . <br /> C . Nothing in the above shall be deemed <br /> to restrict earlier action by the <br /> Harbormaster or an Assistant Harbormaster , <br /> with or without notice to the owner , if , <br /> in their judgment , such action is necessary <br /> to protect life or property, or if such <br /> object is a hindrance to navigation . <br /> -77- <br />
