Any <br /> such device placed without such permission <br /> may be summarily removed by the <br /> Harbormaster without notice or hearing, if <br /> he determines the same to be hazardous to <br /> navigation or restrictive of recreational <br /> use of the water . Said device may be <br /> disposed of as provided for in Section <br /> 4.7.4 of this by-law. <br /> (Amended at Special Town Meeting November <br /> 91 1981 , Approved by Attorney General <br /> February ib, 1982) . <br /> Section 4.7.3. 1 Permits. The Harbor Master shall have <br /> the exclusive right to issue permits for <br /> the placement of moorings for vessels, <br /> boats, rafts and floats held by anchors or <br /> bottom moorings at any locations within <br /> the territorial jurisdiction of the Tot-in . <br /> Section 4.7.3.2 Regulations. The Harbor Master shall <br /> adopt regulations for anchoring of and the <br /> placement and maintenances of moorings to <br /> anchor boats, vessels, rafts and floats an <br /> make these available upon request to any <br /> applicant for a permit . <br /> I <br /> Section 4.7.3.3 Fees. The Harbosr Mastser shall collect a <br /> fee of Twenty Dollars ($20 .00) annually <br /> for each permit for a mooring he issues. <br /> Section 4.7.3.4 Violation . Any violation of the . <br /> provisions of Article 4 .7.3 shall be <br /> punished by a fine of not more than Fifty <br /> Dollars ($50 .00) . <br /> I <br /> Section 4.7.3.5 Removal of Mooring. If the owner of a <br /> mooring refuses or fails, after notice from <br /> the Harbor Master , to relocate or remove <br /> his mooring within such time as the Hart-or <br /> Master adjudges reasonable , or if the <br /> Harbor Master is unable to ascertain the <br /> owner of the mooring, the Harbor Master may <br /> cause such mooring to be removed or <br /> relocated and the Town may recover of the <br /> owner the cost of such removal or <br /> j relocation in a sum not to exceed Fifty <br /> Dollars ($50 .00) Any such mooring may be <br /> disposed of as provided for in Section <br /> 4.7.4 of this 8y-law.
