Article 4. 10 Director of Public Works Section 4. 10 . 1 Authority. This by—law prescribes certain powers and duties of the Director of Public Works. He is authorized to issue permits for work to be performed upon any town highways G or section thereof . Section 4. 10 .2 Digging Uo Town Highways: Permit .- No own highway shall be dug up or opening made therein for any purpose , nor shall any material be dumped or placed thereon i' or removed, or construction or structure placed thereon or removed therefrom, or changed, without the written permission ' of the Director of Public Works. The work shall be done under his supervision and to his satisfaction ; and the entire expense of replacing and resurfacing the highway at I the same level and in as good condition as. I before , with material equal in C specifications to those removed, shall be paid by the person to whom the permit was given or by whom the work was done . Section 4. 10 .3 Digging Uo Town Highways: Bond The Town may require a bond to guarantee the faithful and satisfactory performance of I' the work and payment for any damage to town highways and facilities caused by or resulting from the operations authorized by such permit . The amount of said bond shall I; be not less than one thousand dollars and �! not more then fifty thousand dollars. Except as provided herein , any person who digs up or makes an opening in a town highway without a permit or violates any other provisions of the section shall be punished by a fine of not more than $200 .00 for each day for a continuing offense . Section 4. 10 .4 Access to Town Highway. The fundamental s objective of this section is threefold: F 1 . To provide maximum protection to the public through the orderly control Of traffic moving onto and from a highway. 2. To provide a uniform i p practice in the design and construction of entrances and exists. -83-
