Article 4. 10 Director of Public Works <br /> Section 4. 10 . 1 Authority. This by—law prescribes <br /> certain powers and duties of the <br /> Director of Public Works. He is <br /> authorized to issue permits for work <br /> to be performed upon any town highways G <br /> or section thereof . <br /> Section 4. 10 .2 Digging Uo Town Highways: Permit .- No <br /> own highway shall be dug up or opening <br /> made therein for any purpose , nor shall <br /> any material be dumped or placed thereon <br /> i' <br /> or removed, or construction or structure <br /> placed thereon or removed therefrom, or <br /> changed, without the written permission ' <br /> of the Director of Public Works. The work <br /> shall be done under his supervision and <br /> to his satisfaction ; and the entire expense <br /> of replacing and resurfacing the highway at I <br /> the same level and in as good condition as. I <br /> before , with material equal in C <br /> specifications to those removed, shall be <br /> paid by the person to whom the permit was <br /> given or by whom the work was done . <br /> Section 4. 10 .3 Digging Uo Town Highways: Bond The <br /> Town may require a bond to guarantee the <br /> faithful and satisfactory performance of I' <br /> the work and payment for any damage to <br /> town highways and facilities caused by or <br /> resulting from the operations authorized by <br /> such permit . The amount of said bond shall I; <br /> be not less than one thousand dollars and �! <br /> not more then fifty thousand dollars. <br /> Except as provided herein , any person who <br /> digs up or makes an opening in a town <br /> highway without a permit or violates any <br /> other provisions of the section shall be <br /> punished by a fine of not more than $200 .00 <br /> for each day for a continuing offense . <br /> Section 4. 10 .4 Access to Town Highway. The fundamental s <br /> objective of this section is threefold: <br /> F <br /> 1 . To provide maximum protection to the <br /> public through the orderly control <br /> Of traffic moving onto and from a <br /> highway. <br /> 2. To provide a uniform i <br /> p practice in <br /> the design and construction of <br /> entrances and exists. <br /> -83- <br />
