i <br /> I <br /> Article 4 9 Shellfish and Herring Regulations <br /> I <br /> Section 4.9. 1 The Board of Selectmen are authorized, from <br /> time to time , to make regulations governing <br /> the taking of shellfilsh from the <br /> foreshores flats and tidal waters of the <br /> Town of Mashpee . No such regulations shall <br /> become effective until a public hearing has <br /> been held by the Board of Selectmen and <br /> public notice of the regulations adopted <br /> shall have been given . The Selectmen shall <br /> be governed by all applicable General Laws <br /> in carrying out the authority vested in <br /> them by this By-Law. Any violation of a <br /> regulation duly adopted by the Board of <br /> Selectmen shall be punished by a fine of <br /> $50 (fifty dollars) . <br /> Section 4.9.2 The Board of Selectmen is authorized to <br /> appoint one or more herring wardens and is <br /> authorized, from time to time , to make <br /> regulations concerning the opening and <br /> maintenance of ditches, sluice ways or <br /> j canals into any pond within the Town not in <br /> private possession for the introduction and <br /> propagation in such pond or in any part <br /> thereof of herring, alewives or other <br /> swimming marine food fish , and for the <br /> creation of fisheries for the same . No <br /> such regulation shall become a*fective <br /> until a public hearing has been held by <br /> the Board of Selectmen and public notice of <br /> the regulations adopted shall have been <br /> j given . (Amended at Special Town Meeting, <br /> December 2, 1985 and approved by Attorney <br /> General , February 11 , 1980 .
