by a fine of Twenty Five ( 25) dol l ars . <br /> j Any such violation shall constitute a <br /> separate offense on each successive <br /> occurrence . <br /> "The provisions of Massachusetts General <br /> I Laws Chapter 40 , Section 21D providing for <br /> the noncriminal disposition of by-law <br /> violations shall be applicable and the <br /> { j person taking cognizance of any violation <br /> shall have available as an alternative to <br />- initiating criminal proceedings the <br /> procedure set forth in Section 21D as <br /> '! <br /> aforesaid. " <br /> Section 4. 5.3.5 " In the event that any part of this by-law <br /> is found to be inconsistent with any other <br /> provisions contained in other sections of <br /> the Town by-laws, it is intended that this <br /> particular by-law shall take precedence <br /> and control <br /> In the event that any part of this by-law <br /> is declared void for any reason , by any <br /> court of competent .jurisdiction , the <br /> remainder thereof shall continue in full <br /> force and effect . " <br /> (Amended by Annual Town Meeting May 3, 1982 <br /> and approved by Attorney General September <br /> 7, 1982) . <br /> Section 4 .5. 4 Unciarayed, Unregistered Vehicles. No <br /> person shall have more than one <br /> unregistered car or truck ungaraged on his <br /> premises in a Residential District at any <br /> time . In no event will an unregistered car <br /> or truck be stored in the front yard. <br /> Violaters shall be fined in an amount not <br /> exceeding $20 . 00 for each offense . <br /> i <br /> Section 4.5.5 Deleted at Annual Town Meeting May 39 1982 <br /> and approved by Attorney General September <br /> 7, 1982. <br /> i <br /> Section 4.5.6 Sleeping in Public . No person shall <br /> sleep in a motor vehicle parked upon any <br /> public way or public parking area, or <br /> sleep in the open on any beach t,iithin <br /> the limits of the Town of Mashpee between <br /> the hours of 9:00 p .m. and 6: 00 a .m. Any <br /> person violating this by-law shall be <br /> punished by a fine of not more than $50 .00 <br /> for each offense . <br /> -36- <br />
