the address appearing on the most recent assessing <br /> records of the Town and to the occupant at the address <br /> of the premises where the violation has occurred . " <br /> 14.4 If the Building Inspector , after being requested in <br /> writing to enforce the zoning by-law against any <br /> violation thereof , declines to act , he shall notify , <br /> in writing , the party requesting such enforcement of <br /> any action of refusal to act , and the reasons <br /> therefore , within 14 days of receipt of such written <br /> request for enforcement . Any person aggrieved by <br /> reason of inability to obtain enforcement action from <br /> the Building Inspector may appeal the decision not to <br /> act to the Board of Appeals . The Board of Appeals <br /> shall , at a public meeting , review the allegation of <br /> violation of the zoning by- law , the Building <br /> Inspector ' s reasons for refusal to act , and any <br /> other information it deems necessary and relevant , <br /> and it may , by majority vote , decide to issue a notice <br /> of violation and demand for abatement in the same <br /> manner as prescribed for the Building Inspector in <br /> Subsection 14 . 3 . <br /> 14.5 If the Building Inspector or the Board of Appeals <br /> issues a notice of violation and demand for <br /> abatement and if such alleged violation has not <br /> been abated within the time specified in the <br /> written notice , the Building Inspector or the Board <br /> of Appeals , as appropriate , shall institute legal <br /> action or proceedings on behalf of the Town to <br /> prevent , correct , restrain , abate , or punish any <br /> violation of this by-law. The provisions of this <br /> by- law shall be enforceable by injunctive action <br /> as provided for in the General Laws in addition <br /> to all other remedies available at law or in <br /> equity . All officials , departments , boards , <br /> commissions , or employees of the Town vested with <br /> the authority or duty to issue permits , certificate , <br /> licenses , or approvals shall comply with the <br /> provisions of this by- law and shall not issue any <br /> such permit , certificate , license or approval <br /> regarding any structure , use , development , or site <br /> which is not in conformance with the provisions of <br /> this by- law or which is the subject of any violation <br /> enforcement proceeding initiated by the Building <br /> Inspector or other agent to the Town . Any person , <br /> owner , agent or other legal entity , against whom <br /> i <br /> such violation enforcement procedure has commenced , <br /> shall not be permitted to apply for a permit to <br /> construct or for a variance for any matter related <br /> to the alleged violation until the violation <br /> enforcement proceedings have been finally <br /> determined by the proper authority . " <br /> 14 - 2 <br />
