water body or water supply well. <br /> (h) A comparison, on a per-acre basis, of the total nutrient <br /> loading from the proposed project with the loading rate <br /> which would be expected to produce critical eutrophic <br /> levels in a water body (.02 mg/litre total phosphorus in <br /> fresh water bodies, .75 mg/litre total nitrogen in salt <br /> water bodies) or, in the case of a water supply, the load- <br /> ing rate which would produce nitrate-nitrogen levels in ex- <br /> cess of five (5) parts per million. Where the per-acre <br /> loading rate from the proposed project will equal or exceed <br /> the critical loading rate when combined with existing and <br /> potential development within the recharge area of the water <br /> body or water supply well , the Report shall specify <br /> j measures to reduce nutrient loading such as sewage treat- <br /> ment, reduction of development density, elimination or re- <br /> duction of lawn areas and other appropriate measures. <br /> 6.5.3 No Definitive Subdivision Plan or Special Permit subject to the <br /> provisions of Section 6.5 may be approved by the Planning Board <br /> unless it has determined, after reviewing the Water Quality <br /> Report and any comments from the Board of Health, that the pro- <br /> j posed project will not have a significant adverse affect on <br /> public health or safety, aquatic vegetative resources, any fish- <br /> eries or shellfish beds or other wildlife due to hazardous or <br /> toxic materials, roadway drainage or sedimentation or excessive <br /> nutrient levels. Where feasible, the Board shall ensure that <br /> the nutrient contribution of the proposed development, when <br /> added to the existing and potential nutrient level of other <br /> development and acreage within the specific recharge area, will <br /> not result, on a pounds-per-acre basis, in nutrient levels that <br /> exceed the receiving surface waters' critical eutrophic level <br /> or, in the case of well recharge areas, nitrate-nitrogen con- <br /> centrations in the well in excess of five (5) parts per million. <br /> It shall be the responsibility of the applicant to demonstrate <br /> that any pro posed mitigating measures required to produce a <br /> negative determination regarding the above items will work as <br /> designed, and the Planning Board may require, as a condition of <br /> any approval , that the applicant or his successor demonstrate on <br /> ' an annual basis that said mitigating measures are operating <br /> satisfactorily.
