9 .3 .3.4 Any open space required to meet the minimum <br /> provisions of Subsection 9.3. 3 shall be permanently <br /> dedicated in one of th,e following ways : <br /> (a ) Public Ownership - The open space shall be conveyed <br /> in fee to the Town of Mashpee and accepted by it <br /> ' i <br /> for park or open space use. <br /> (b ) Ownership by a non-profit organization - The open <br /> space shall be conveyed to a non-profit <br /> organization , the principal purpose of which is the <br /> _ ? conservation of open space. The non-profit <br /> 3 organization shall execute a restriction <br /> enforceable by the Town of Mashpee which shall be <br /> recorded at the Barnstable County Registry of Deeds <br /> providing that such land shall be kept in an open <br /> and natural state and shall not be built on for <br /> residential use or developed for accessory uses <br /> such as parking or roadway or any other uses not <br /> allowed by Subsection 9 .3 in minimum open space <br /> areas . The non-profit organization shall own and <br /> shall maintain the common open space and shall not <br /> dispose of any of the common open space by sale or <br /> otherwise except that said non-profit organization <br /> may offer to convey such open space to the' Town of , <br /> { Mashpee for acceptance by it for park or open space <br /> l use . <br /> (c ) Ownership by a corporation or trust - The open <br /> space shall be conveyed to a corporation or trust <br /> owned or to be owned by the owners of the lots or <br /> residential units within the development . <br /> Ownership of the corporation or trust shall pass <br /> with conveyance of the lots or residential units . <br /> The corporation or trust shall execute a <br /> restriction enforceable by the Town of Mashpee <br /> i which shall be recorded at the Barnstable County <br /> 1 Registry of Deeds . Said restriction shall provide <br /> that such land shall be kept in an open and natural <br /> state and not be built on for residential use or <br /> i developed for accessory uses such as parking or <br /> roadway or any other uses not ailflwed by Section <br /> i 9 .3 in minimum open space areas . The corporation <br /> or trust shall own and maintain the open space and <br /> shall not dispose of any of the open space by sale <br /> or otherwise except that said corporation or trust <br /> may offer to convey such open space to the Town of <br /> Mashpee for acceptance by it for park or open space <br /> use. <br /> 9.3 .3. 5 The developer ' s declaration of his choice of <br /> the three methods described in Subsection 9 . 3 .3 .4 above, <br /> shall be included in his application to the Planning <br /> '�� Board for a Special Permit to develop an OSID, along <br /> I <br /> 9 - 6 <br />
