SECTION 11B : GROUNDWATER PROTECTION DISTRICT <br /> 1 . AUTHORITY <br /> This by-law is adopted by the Town of Mashpee under its <br /> home rule powers , its police powers to protect the <br /> public health , safety and welfare , and under powers <br /> authorized by Mass . Gen . Laws , Ch . 41A, as amended . <br /> 2 . PURPOSES <br /> The purposes of this by-law are to protect public — <br /> health from the contamination of existing and potential <br /> public and private water supplies and to protect the <br /> general welfare by preserving limited water supplies <br /> for present and future use. <br /> 3 . DEFINITIONS <br /> 3 . 1 "Animal feedlot" means a plot of land on which <br /> twenty—five or more livestock per acre are kept <br /> for the purposes of feeding. <br /> 3 .2 "Aquifer" means a geologic formation, group of <br /> formations or part of a formation which contains <br /> sufficient saturated permeable material to yield <br /> significant quantities of potable groundwater to <br /> public or private wells . <br /> 3 .3 "Disposal " means the deposit , injection , dumping , <br /> spilling , leaking , incineration or placing of any <br /> hazardous material into or on any land or water so <br /> that such hazardous material or any constituent <br /> thereof may enter the environment or be emitted <br /> into the air or discharged into any waters , <br /> including groundwater. <br /> 3 .4 "Groundwater" means all the water beneath the <br /> surface of the ground . <br /> 3 .5 "Hazardous materials " means any substance or <br /> combination of any substances , not including any <br /> liquid petroleum product , that , because of <br /> quantity , concentration or physical , chemical or <br /> infectious characteristics , poses a significant <br /> present or potential hazard to water supplies or <br /> to human health if disposed of into or on any land <br /> or water in this Town . Any substance deemed a <br /> "hazardous waste" in Mass . Gen . Laws , Ch . 21C <br /> shall also be deemed a hazardous material for <br /> purposes of this by-law. <br /> 11 - 7 <br />
