3 .6 " Impervious" means impenetrable by water. <br /> . , 3 .7 "Leachable wastes " means waste materials , <br /> including solid wastes , sewerage , sludge and <br /> agricultural wastes , that are capable of releasing <br /> water-borne contaminants to t-he surrounding <br /> environment . <br /> k 3 .8 "Mining of Land" means the removal or relocation <br /> of geologic materials such as topsoil , sand , <br /> gravel , metallic ores and bedrock . <br /> 3 .9 "Recharge area" means any area of porous , <br /> permeable geologic deposits , espe- ially , but not <br /> exclusively , deposits of stratif , d sand and <br /> gravel , through which water from any source drains <br /> into an aquifer , and includes any wetland or body <br /> `+� of surface water surrounded by or adjacent to such <br /> i. <br /> area , together with the watershed of any wetland <br /> or body of surface water adjacent to such area . <br /> 3 . 10 "Solid wastes " means useless, unwanted or <br /> y discarded solid materials with insufficient liquid <br /> content to be free flowing , including , for <br /> example , rubbish , garbage , scrap materials , junk , <br /> refuse , inert fill material and landscape refuse . <br /> 4 . DELINEATION OF GROUNDWATER PROTECTION DISTRICT <br /> 4 . 1 For the purposes of this by- law there is hereby <br /> established within the Town of Mashpee an overlay <br /> district consisting of certain groundwater <br /> protection areas , including aquifers and recharge <br /> areas , which are delineated on a map dated <br /> April , 1987 entitled "Groundwater Protection <br /> District , Town of Mashpee" and which shall be <br /> considered as superimposed over other districts <br /> established by the zoning by- laws of this town . <br /> This map , as it may be amended from time to time , <br /> is on file with the office of the Town Clerk , and, <br /> with any explanatory material thereon , is hereby <br /> made a part of this by-law . <br /> i1. <br /> 4 .2 Uses otherwise not permitted in the portions of a <br /> zoning district superimposed by this district <br /> shall not be permitted in this district . <br /> 4 . 3 Where the bounds of the Groundwater Protection <br /> District, as delineated on the Groundwater <br /> Protection District map , are in doubt or in <br /> dispute , the burden of proof shall be upon the <br /> owner(s ) of the land in question to show where <br /> they should properly be located .
