in residences within the OSID , and that the proposed use <br /> will have no significant adverse effect on neighboring <br /> properties outside the OSID, on residents within the <br /> OSID or on the Town ' s environment and natural resources . <br /> In no case shall the Board allow more than ten ( 10 ) <br /> square feet (gross first floor area ) of such uses per <br /> residential dwelling unit within the OSID and in no case <br /> may such uses by located less than three hundred (300) <br /> feet from the property line of the OSID. <br /> 9.3.3 OPEN SPACE REQUIREMENTS - A minimum of fifty (50 ) <br /> percent of the upland area of the parcel or parcels <br /> included within the OSID shall be permanently dedicated <br /> as open space . <br /> 9 . 3 .3 . 1 This minimum required open space shall lie <br /> within a primary or secondary conservation area shown on <br /> the "Mashpee Open Space Incentive Plan " and shall be <br /> left in essentially its undisturbed natural state , <br /> except for pedestrian , equestrian or bicycle trails , <br /> minor clearing for passive recreation purposes , such as <br /> picnicking , areas disturbed for water wells , pumphouses <br /> and related access , provided that such uses may disturb <br /> no more than five (5 ) percent of such open space. In no <br /> case shall such area be used for roads , parking , <br /> playgrounds , golf course , tennis courts or other uses <br /> requiring significant amounts of clearing , structures or <br /> paving . In any OSID, all upland within three hundred <br /> (300 ) feet of the mean high water line of great ponds or <br /> the rivers listed in subsection 9 . 3 . 1 , as well as any <br /> upland within one hundred and fifty ( 150 ) feet of other <br /> water bodies , streams , bogs or wetlands as noted in <br /> subsection 9 . 3 . 1 above shall be included within such <br /> dedicated undisturbed natural open space , except that <br /> where the developed portion of the OSID exceeds one <br /> hundred ( 100 ) acres , upon approval of the OSID Special <br /> Permit by the Planning Board in consultation with the <br /> Conservation Commission , Shellfish Commission and <br /> Harbormaster , and upon approval of any permits required <br /> from the Conservation Commission , up to one hundred <br /> ( 100 ) feet of the shoreline , and a corresponding one <br /> hundred ( 100 ) foot wide corridor roughly perpendicular <br /> to the shoreline through any open space , may be <br /> developed for use as a dock , marina , boat launch or <br /> other water-related facility , such as a waterfront park <br /> or picnic area not involving active recreation <br /> facilities , enclosed structures or paved areas covering <br /> more than ten percent of such corridor area . The area of <br /> such corridor and facilities shall not count toward the <br /> required 50% open space or be credited for bonus units <br /> under section 9 .4. In addition to the minimum required <br /> open space in primary and secondary conservation areas , <br /> other undisturbed natural open space is encouraged <br /> adjacent to the required buffer areas from water and <br /> wetland's , and/or adjacent to existing or proposed <br /> 9 - 4 <br />
