TOWN OF MASHPEE <br />Board of Appeals <br />October 23, 1974 <br />SUBJECT: Decision of the Board of Appeals on the appeal and <br />petition of: Whitehall Co., Ltd., for a Variance <br />under the Zoning By -Law. <br />HEARING: October 23, T974 - 7:30p.m. <br />FACTS: The petitioner has requested a Variance to the Front <br />Minimum Yard Depth (setback) requirements in an <br />Industrially zoned district (,•an•I district). The <br />property is located on Echo Road off Route 130. <br />The locus is Three Hundred (3001� feet in depth and <br />Four Hundred (4001) feet wide. The required minimum <br />Front Yard Depth (setback) is One Hundred Fifty <br />(1501) feet, and the minimum'Rear Yard Depth is <br />Fifty (501) feet. Petitioner is requesting a Variance <br />to allow a structure (warehouse) to exist with a <br />Front Yard Depth of Sixty (60+) feet. <br />DECISION: In view of the fact that the lot is only Three Hundred <br />(3001) feet in depth, and the total minimum yard <br />requirements are Two Hundred (200t) feet, it is our <br />decision that this amounts to a condition especially <br />affecting this parcel and that a literal enforcement <br />of this provision of the Town of Mashpee Zoning By -Law <br />would involve substantial hardship to the appellant. <br />We further believe that by granting this Variance <br />there will be no detriment to the public good and that <br />this decision is in no way nuffifying or derogating <br />from the intent or purpose of any Zoning By -Law in <br />the Town of Mashpee. <br />VOTE: UNANIMOUS <br />Clara L.
