TOWN OF MASHPEE <br />BOARD OF APPEAL <br />SUBJECT: Board of Appeals Hearing on Application of James C. Gahan III to <br />Construct and operate a riding stable in the Mall Section of New Seavury <br />Development in South Mashpee <br />DATE OF HEARING: 4 December 1974 7:00 pm <br />BOARD MEMBERS: Clara L. Keliinui, Chmn, John A. Boyle, Clerk, Randolph G. Peters, <br />Alternate member <br />FACTS: Petitioner has applied for a Special Permit to construct and operate a stable <br />and riding facility in the Mall Section of the New Seabury development in South <br />I Mashpee. Under the by—laws of the Town of Mashpee, a Special Permit is required under <br />provisions of Section 6.3 Land Use Regulations, sub —section B-13. <br />DECISION: The Board of Appeals has unanimously voted to grant the petitioner a <br />Special Permit to construct and operate a stable and riding facility. It is the <br />unanimous opinion of this board that the granting of this Special Permit would be <br />in harmony with the general purpose and intent of the zoning by—laws. It has been <br />further determined that such recreational facility is not detrimental to the town <br />or the area by reason of excessive traffic noise or demand on community facilities. <br />CONDITIONS: In granting above Special Permit, the petitioner is obliged to abide <br />by the following conditions. Mon —compliance could result in revocation of Special <br />permit: <br />1. Stable will be located at furtherest point from residential area. <br />2. Height of building cannot exceed twenty—six (26) feet. <br />3. Entire property to be greenbelted and fenced. <br />4. Number of stalls to be limited to thirty—six (36). <br />5. Fencing will be errected on northerly side of Hush Road. No horses <br />will be permited to cross Hush Road. <br />6. Daily removal of animal waste is mandatory. <br />7. Adequate number of fly traps and other devises will be int;talled to <br />limit the potential insect problem. <br />8.
