COMMONWEALTH OF MASSACHUSETTS <br />Town of Mashpee <br />Board of Appeals <br />July 10, 1974 <br />Subject: Decision of the Appeals Board on the Appeal of Henry <br />C. Labute to construct a store for retail sales. <br />DATE OF HEARING: 19 June 1974, 7:30 p.m. <br />BOARD,MEMBERS: Clara Keliinui <br />Kevin D. O'Connell <br />John M. Boyle <br />FACTS: Petitioner has requested a Special Permit to construct <br />a building on Route 151 and Ninigret Avenue to be used <br />as a retail store under provisions set forth in E.1 of <br />Section 6.3 Land Use Regulations. Land to be used is <br />in a C-2 zoned area. <br />The Petitioner has met or exceeds all of the require- <br />ments as established in the Mashpee zoning by-law <br />under Section 7; Land Space Requirements, and Section 8 <br />Off Street Parking. The plan of proposed retail store <br />is on file with the Board of Appeals, The Board has <br />determined that the granting such permit is in the best <br />interest of the community and would not be detrimental <br />to the Town or the area by reason of excessive noise or <br />demand on community facilities. <br />DECISION: The Board herewith grants to Henry C. Labute a Special <br />Permit to construct a building on Route 151 and Ninigret <br />Avenue to be used specifically as a retail sales store <br />The granting of said Special Permit is subject to the <br />following conditions as pertains to egress and ingress: <br />In the interest of public safety and traffic control, <br />the petitioner will be required to establish the entrance <br />from Route 151 to parking area; the exit will be established <br />from the parking area into Ninigret Ave. Above traffic <br />control will be effected on or before date retail store <br />is opened for business. <br />
