TUM OF MASHPEE <br />BOARD OF APPEALS <br />1.1 <br />�h <br />21 April 1974 <br />Subject: Decision of the Board of Appeals on petition for a variance to <br />construct a garage closer to side and front lot lines than allowed <br />under current Mashpee zoning by-laws. <br />Petitioner: Barbara A. Dymsza <br />Date of hearing: 18 April 1974 <br />Appeals Board members: Clara L. Keliinui, Kevin D. O'Connell, Randolph G. Peters <br />FACTS <br />Property in question is located on Lft 2812 Bight Circle, New Seabury section <br />of Mashpee. Peitioner is seeking relief from the front and side line requirements <br />stipulated under Section 7.4 Mashpee Zoning by-law. Due to the configuration of <br />existing building on Lot 281 which is 16,500 square feet in area, the proposed <br />location of garage would be 6 feet from side line abutting Lot 280, and set back <br />of 14 feet from Bight Circle. <br />Bight Circle is not a through street. It is located off Popponesset Island <br />Road and primarily services lots 280, 281 and 282. <br />No side, rear or front line requirements were in effect when existing house <br />was built. <br />Abutters were duly notified of public hearing. No abutters attended hearing <br />nor were any written communications received expressing opposition. <br />Drawings of proposed garage on file with Appeals Board, indicate that <br />structure will be asthetic with existing building on L6t 281 and other homes in <br />surr ounding area. <br />DECISION <br />In view of the above facts, the Appeals Board voted unanimously to grqnt the <br />petitioner a variance authorizing construction of a garage on Lot 281 Bight Circle, <br />New Seabury, with a minimum 6 foot side line abutting Lot 280, and a minimum set <br />back of 14 feet from Bight Circle. <br />E C E I V E D <br />i <br />I <br />r,CO ry <br />�• �• <br />WEE TOWN CLERK <br />
