THE COMMONWEALTH OF MASSACHUSETTS
Town OF Mashpee
BOARD ®E APPEALS
.............Feb...13.......................... 19__7?...
Decision of the Board of Appeals on the appeal and petition of
Fields Point Mfg.
..........- ............... •................... •.... _............... _......_................................. ----.. _. _ _. _.. _......................... _..............
Hearing: January 7P 1973 8:PM Mashpee Town Hall
Petitioner: Fields Point Mfg.
Petition: For a Special Permit to continue a khs use of a non -conforming building.
Appeals Board: Peter M. Lawrence
Kevin D. O'Connell
Randolph Peters
Facts: The existing building is located in a C-1 area. Under current zoning a set-
back of 100 feet is required from the front lot line. The building has ex-
isted for many years with a setback of only 45 feet from the front lot line.
The petitioner requests a Special Permit to continue the use of'the building
as a real estate office.
Decision: The building has existed for many years set back 45 feet from the lot
line. The intended use of the building for an office is within keeping with
the intent of the by-law. The set back of the building is equal to the set-
back of other buildings on the lot. The parking area was found to be suff-
icient for the intended use. It is.therefore, the decision of the Appeals Board
to issue a Special Permit to the petitioner for the continuation of s.bhe
buildingt known as the Epicure Shop at Pine Tree Cornert as a non -conforming
use.
Vote: Unanimous
FORM 1095 HOBBS @ WARREN, INr.
