BOARD OF APPEALS <br /> TOWN OF MASHPEE <br /> Re : Application of Marvin Edward Roberts , c/o Ockry Trading <br /> Post for a Special Permit for the retail sale of mer- <br /> chandise. ',.. <br /> FACTS <br /> A petition was duly filed by the Petitioner for a <br /> Special Permit under Land Use Regulations , Chapter 6. 3 , <br /> Section E-1 as pertains to the retail sale of merchandise <br /> in a commercially zoned area. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws , Chapter 40A as amended by Chapter <br /> 808 of the Acts of 1975. Notice was given by publication by <br /> publishing in the Falmouth Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee on December 13 , 1977 and <br /> December 23 , 1977 , a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, January 4 , 1978 at 7 : 30 P .M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout : Clara L. Keliinui , Chairman ; <br /> Peter C. Muse , Alternate ; and Robert J. Houle , Alternate. <br /> The Petitioner was requesting the use of a building <br /> on his property, between the Ockry Trading Post and the <br /> Mashpee Fire Barn , for the retail sale of antiques and <br /> j collectables.
