MEMORANDUM OF FACTS AND REQUESTS FOR FINDINGS <br /> Re : Petition of Augat, Inc . ( "Petitioner" ) to <br /> the Board of Appeals ( "Board" ) of the <br /> Town of Mashpee ( "Town" ) for a special <br /> permit for the extension and enlargement . <br /> of non-conforming uses respecting land on <br /> Falmouth Road (Route .28) , ' Mashpee <br /> (the "Premises" ) . <br /> BACKGROUND <br /> The Premises consist of a 13 . 12 acre parcel <br /> situated on Falmouth Road (Route 28) , Mashpee, on which is <br /> situated an existing manufacturing facility (the "Existing <br /> Building" ) and an addition thereto presently under construction <br /> (the "Addition" ) , all as shown on the site plan 'prepared by . <br /> Oman Associates , Inc . dated July 5, 1978, last revised January , <br /> 1979, a copy of which has been submitted herewith (the "Plan") . <br /> The Premises are situated in an I-1 Industrial <br /> District . The Premises were zoned industrial pursuant. to <br /> Article 1 of the January 26, 1967 Special Town Meeting, a <br /> copy of which is attached hereto as Exhibit A. <br /> The Existing Building and adjoining guest parking <br /> in the front were constructed in accordance with a building <br /> permit dated April 4 , 1967, a copy of which is attached hereto <br /> as Exhibit B. At that time, there was no minimum front yard <br /> depth requirement in the Industrial District, nor was there <br /> any prohibition against parking within the first 100 feet of <br /> the front yard. <br />
