In 1971, the Mashpee Zoning By-Law was amended to <br /> require a 150-foot minimum front yard depth in Industrial <br /> Districts and to preclude parking within the first 100 feet <br /> of the front yard . Accordingly, the Existing Building, and <br /> the appurtenant front yard parking, constituted non-conforming <br /> structures within the meaning of Section 5 . 1 of the Mashpee <br /> Zoning By-Law. <br /> The Addition is currently being constructed in <br /> accordance with a building permit dated July 31 , 1978, a copy <br /> of which is attached hereto as Exhibit C. The portion of the <br /> Addition in question involves an 80-foot extension of the front <br /> wall of the Existing Building, which is 100 feet from the <br /> edge of Falmouth Road, and the addition of ten parking spaces <br /> to the existing . guest parking spaces, both as shown on the <br /> Plan. <br /> Petitioner seeks a special permit from the Board <br /> authorizing the extension or enlargement of the non-conforming <br /> use described above. <br /> BASIS FOR SPECIAL PERMIT <br /> Section 5. 1 of the Mashpee Zoning By-Law, as <br /> amended, provides as follows : <br /> "NON-CONFORMING BUILDINGS AND USES <br /> 5. 1 Any lawful use of any structure or land or <br /> both may be continued although not conforming with <br /> the provisions of this By-Law, but no such lawfully <br /> non-conforming use shall be changed, intensified, <br /> -2- <br />
