DEC`1SI ON i The Board of Appeals held a public hearing on the application of Cape Waterslide, Inc . for a special. .permit to constructa water- slide in a C-1 zone on land located off Route 28 . The application was filed with the Town Clerk on January 3, 1983 and notice of public hearing was published on January 18, 1983 and January 25 , 1983 in the Falmouth Enterprise. _ Notice of the hearing was mailed to Fields Point Manufacturing Corp . , Danbil Corp . , Joseph, Lena C. and Joseph Jr . Gracia, the Mashpee Board of Selectmen, Building Inspector , Planning Board, and the Planning Boards of the .towns of Barnstable, Bourne, Falmouth and 'Sandwich. A public hearing was held February 2 , 1983 at the Town Hall . In attendance were Board of Appeals members Michael Makunas , Virginia T . Landry, and Manual E. Costa, Jr . . Attorney Michael A. Dunning appeared for the Petitioner, Cape Water- slide , Inc . and offered an oral presentation, as well as a written out- line of the proposed Project for which a special permit was sought . He identified the locus , :described the proposed activity, and in general terms discussed the project that was outlined in the written document he presented. Discussion followed the presentation by attorney Dunning, and various questions were asked by members of the public in attendance , and answers were given by attorney Dunning and Mr . Slavinski the engineer for the project who was in attendance. Mr. Paliuca, the owner of Danbill Corp . , an abutter, inquired as to the water utilization in the project and the effect that it would have on the underground supply of water . He commented that wells would be necessary and he was concerned over the limited supply of ground water. 'available to supply his business and that of the abutting businesses . Mrs . -B. Jean Thomas , the Chairman of the Board of Selectmen, inquired as to the gallons of water that would be used by the project , and also inquired as to the distance of the project from Route 28 and from Great Neck Road. She also commented on the congested traffic conditions that existed in the Summer months on Route 28, Great Neck Road, and at the Mashpee Rotary where these two roads intersect . She commented that she felt the project would add uridesiTable amounts of traffic . She also made known the fact that she was a member of the Mashpee Growth Study Committee and that a two year study had been concluded by this committee utilizing the services of' a processional planner in the employ of the Town . She indicated that the result of this two year study was a recommendation for zoning change to a village cluster zoning concept and that locus was located in the .middle of the proposed new zone . She further indicated that a amusement activity of this kind wascnot compatible with the proposed new zone, and that this entire area was in dire need of change in order to preserve and protect the Town. .
