It was further noted that there <br /> would be a significant number of children attracted to .this amusement <br /> because of its, appealability to children. Discussion was held concerning <br /> the danger to children walking and riding bicycles on Route 28 and <br /> Great Neck Road. <br /> It was also observed that the comment of the Planning Board <br /> to require landscaping for a park or viewing area with no parking, <br /> and that signs be pre-approved by the Planning Board, were both <br /> excellent suggestions in the event the Board of Appeals'. determined <br /> that a special permit should be granted. However, the Board of <br /> Appeals members feel that the Planning Board did not specifically <br /> address the traffic problem and congested traffic conditions and <br /> the ability of Donna '.s Lane to handle a substantial increase in <br /> traffic flow, and the visual impact of this project on the abutting <br /> property owners and the citizens of the Town in general , or the fact <br /> that Mashpee has a limited water supply and a large volume of water <br /> would be required for a purely recreational and amusement function, <br /> and the overall impact of this proposed amusement facility on the <br /> surrounding neighborhood and on the abutters in particular. In addition, <br /> the Board of Appeals feels that the Planning Board did not give any <br /> weight to the proposed village center concept designed by the professional <br /> planner and recommended by the Growth Study Committee . <br /> After discussion. and deliberation it was moved by Virginia T . Landry <br /> and seconded by Manual E . Costa, Jr . that the application for special <br /> permit be denied on the following grounds : <br /> In the exercise of discretion of the Board of Appeals , pursuant <br /> to the provisions of Section 6 . 2 of the. Zoning By-Law, it is <br /> determined that the proposed project is not in the best interest <br /> of the community. The Board finds that the proposed activity <br /> consisting of an. outdoor waterslide would create additional <br /> traffic in an -already congested area, would not be compatible <br /> with the present and proposed uses of the immediately surrounding <br /> property, is inconsistent with the findings and recommendations <br /> of the Mashpee Growth Study Committee, and would be detrimental <br /> to the public good of the Town of Mashpee in that it would add <br /> nothing to the community which would be of substantial benefit <br /> to the citizens of the Town, and would place an additional <br /> strain on the already limited manpower , equipment , and facilities <br /> of the police, fire and rescue departments of. the Town, would <br /> represent an additional drain on the limited water resources of <br /> the abutting property owners , would subs.tantially contribute and <br /> exacerbate an already existing traffic problem on Route 28 and <br /> Great Neck Road, and would have a negative effect upon the ' <br /> abutting property owners .and the development of their properties <br /> for commercial purposes . In addition, the proposed activity <br /> would be essentially outdoors and the usage of the facility by <br /> people in general , an(Pin particular children, would add an <br /> unacceptable noise level to the area, and as such would be <br /> objectionable to the abutters . The Board specifically finds the <br /> recommendation of . the Planning Board unacceptable and rejects the <br /> same for the reason that thellanning Board did not set forth any <br /> basis for its decision and appears to contradict the findings made <br />
