TOWN OF MASETEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> ryg CA- <br /> RE : Petition of Richard Sewall & Edward Palank for a Special Permit <br /> Case FISP-85-09-058 <br /> A Petition was filed by Richard Sewall & Edward Palank for a <br /> Special Permit for permission to construct a dock in a residential zoning <br /> district on property located on Lots 12 , 13 , 14 , and 15 , Daniel ' s <br /> Island Road , Mashpee , Massachusetts . <br /> Notice was duly given to abutterslin accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town of S. <br /> Mashpee on Septemb.er 11 , 1985 and September 18 , 1985 a copy of which <br /> is attached hereto and made apart hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , September 25 , 1985 , at 7 : 30 p .m. at which time the follow- <br /> ing members of the Board of Appeals were present and acting throughout : <br /> William Hanrahan, Manuel Costa and Michael Makunas . <br /> U <br /> Mr . Clark represented Mr . Sewall & Mr . Palank on this matter . He <br /> explained that the dock was approved by the Conservation Commission <br /> Army Corps . of Engineers and by the Waterways Commission of DEQE. The <br /> proposed dock is less than 45 feet . The important part of this request <br /> according to Mr . Clark was that two lot owners had gotten together to <br /> share one dock. The dock proposed would- be entirely on Mr . Sewall ' s <br /> property . Mr . Clark explained that this was a mutual agreement between <br /> Mr . Sewall and Mr . Palank and would draw up an agreement that will be <br /> recorded at the registry . At this time the petition was taken under <br /> advisement to allow Mr .
